A worker, labour, or mechanic employed on a public work by or on behalf of YES Prep shall be paid: (1) not less than the general prevailing rate of per diem wages for work of a similar character in the locality in which the work is performed; and (2) not less than the general prevailing rate of per diem wages for legal holiday and overtime work. Liquidated Damages: Time is of the essence regarding the performance of all Work. If the Contractor fails to achieve Substantial Completion on or before the date agreed upon contract award. Contractor shall pay to the Owner, as liquidated damages, $250 per day for each calendar day that Substantial Completion is delayed thereafter. Yes Prep, in Its Sole Discretion, Reserves the Right To Accept Any Proposal And/or Reject Any and All Proposals or a Part of a Proposal, Without Reason or Cause, Submitted in Response to This Solicitation. 3. Yes Prep Reserves the Right To Reject Any Non-Responsive or Conditional Proposal.
