Owner reserves the right to reject any and all Bids, to waive any and all informalities, and to negotiate contract terms with the Successful Bidder, and the right to disregard all nonconforming, nonresponsible, or conditional Bids. Owner reserves the right to reject the Bid of any Bidder who does not pass any such evaluation to the Owner's satisfaction. General Conditions are general in scope and may refer to conditions not encountered on the Work. The inapplicability of any portion of the General Condition shall not be interpreted as affecting the validity of any other requirement. The Owner may make changes in the scope of the work required to be performed by the Contractor under the Contract or making additions thereto, or by omitting work therefrom, without invalidating the Contract, and without relieving or releasing the Contractor from any of his obligations under the Contract or any guarantee given by him pursuant to the Contract provision, and without affecting the validity of the guaranty bonds, and without relieving or releasing the surety or sureties of said bonds. All such work shall be executed under the terms of the original Contract unless it is expressly provided otherwise. All disputes arising under this Contract or its interpretations, whether involving law or fact or both, or extra work, and all claims for alleged breach of Contract shall within ten [10] days of commencement of the dispute be presented by the Contractor to the Owner for decision. All papers pertaining to claims shall be filed in quadruplicate. Such notice need not detail the amount of the claim but shall state the facts surrounding the claim in sufficient detail to identify the claim, together with its character and scope. In the meantime the Contractor shall proceed with the work as directed. Any claim not presented within the time limit specified this paragraph shall be deemed to have been waived, except that if the claim is of a continuing character and notice of the claim is not given within ten [10] days of its commencement, the claim will be considered only for a period commencing ten [10] days prior to the receipt by the Owner of notice thereof. Each bid must be accompanied by a certified check, cashier's check or bank draft issued upon a National or State Bank made payable to the City of Mitchell, South Dakota in an amount of no less than five percent (5%) of the bid, or in lieu thereof, a bid bond for ten percent (10%) of the amount of the bid, such bond to be issued by a surety authorized to do business in the State and countersigned by a resident agent payable to the Finance Officer of the City of Mitchell, South Dakota. The Bid Security must accompany the proposal as a guaranty the bidder will enter into a contract within ten (10) days after the notice of award is delivered to the contractor. Checks of the unsuccessful bidders will be returned after award of the contract. Owner reserves the right to reject the Bid of any Bidder who does not pass any such evaluation to the Owner's satisfaction Bidder accepts the provisions of the Agreement as to liquidated damages in the event of failure to complete the Work on time
