Renovation of a mixed-use development in New York, New York. Completed plans call for the renovation of a educational facility.

Path of Travel / Library Upgrade All activities of the Contractor and its Subcontractors required by the Contract. Work includes, but is not limited to, procurement of materials, construction of the Project in whole or in part, and administration and coordination of subcontracts. The Work shall include not only Contractor's obligations that are expressly set forth in the Contract, but also all that is reasonably inferable from the express description of the Work. The Work shall include the activities that Contractor itself performs as well as activities it delegates to its Subcontractors and third parties, and includes, but is not limited to, all documents, reports, studies, tests, inspections and repairs required by the Contract. The Contractor shall make and demonstrate good faith efforts to achieve the SCA's goal that a minimum of thirty percent (30%) of all subcontracted work be performed by SCA and/or New York City ("City") certified minority, women and/or local based enterprises (MWLBEs). All subcontractors must also be in compliance with the SCA's subcontractor approval requirements. Subcontractor must be prequalified with the SCA and have the appropriate trade code Evidence that the Contractor held meetings with MWLBE firms prior to the date bids or proposals were due for the purpose of explaining in detail the scope and requirements of the work for which its bids or proposal was solicited. If the scope of services requires off-site storage or disposal, the selected storage and disposal facilities described in the Work plan are now appropriately licensed and permitted to store and dispose of the waste, materials or hazardous substance detailed within the Work plan. In the event the storage or disposal facility loses its permitted status hereafter during the terms of this Asbestos Subcontract, the Asbestos Subcontractor shall promptly notify the Consultant and the Contractor or Construction Manager, and the SCA of such loss. Bond Notes: Each bid must be accompanied by a bid bond prepared on the form attached to the Construction Contract as Appendix C or a certified check of the Bidder, in the amount of five (5%) percent of the Bid Amount, duly executed by the Bidder as principal, and having as surety thereon a company authorized to do business in New York State and approved by the SCA. Immediately upon receipt of Notice of Intent to Award Letter/Signature Page to the Construction Contract, the successful Bidder shall furnish to the SCA and maintain during the term of the contract, at its own cost and expense a Construction Performance Bond in an amount at least equal to one hundred (100%) percent of the contract price as security for faithful performance of the Contract; and a Labor and Material Payment Bond in an amount at least equal to one hundred (100%) percent of the Contract price for the payment of all persons performing labor on the project under the contract or furnishing materials in connection with the Contract. The surety on such bonds shall be a company authorized to do business in the State of New York and approved by the SCA. Attorneys-in-fact who sign said bonds on behalf of a surety must affix to each bond a certified copy of their power of appointment, indicating the effective period. Owner Rights: The SCA, at its sole discretion, reserves the right to allow the apparent low bidder up to five (5) business days following SCA's notification, to meet the Solicitation's Apprenticeship Program requirements. The Bidder must submit with its Bid the below-listed items as an update of its prequalification application. The SCA reserves the right to require the Bidder to provide additional information and/or clarifications regarding its financial resources following the bid opening. The SCA reserves the right to reject any bid if the information required by the SCA is not submitted as required or if the information submitted fails to satisfy the SCA that the Bidder is responsible, or is able or qualified to carry out the obligations of the Contract, or to complete the Work as contemplated. Subject to the SCA's right to reject all bids, the award of the Contract shall be made to the responsible pre-qualified Bidder submitting the lowest responsive bid. The SCA, at its sole discretion, reserves the right to allow the apparent low bidder up to five (5) business days following SCA's notification, to meet the Solicitation's Apprenticeship Program requirements. Liquidity Damages: The Contractor shall pay to the SCA as liquidated damages the sum of Five Hundred ($500.00) Dollars for each and every continuous calendar day that the Work shall not be completed after the above-stated Completion date or any authorized extension thereof. Failure of the Contractor or a Subcontractor to comply with these Apprenticeship Training Requirements during the Contract Performance Period may result in, among other things, an unsatisfactory evaluation and/or an assessment of special liquidated damages against the Contractor in the amount of two hundred ($200) dollars for each continuous calendar day following the Contractor's receipt of a written SCA notice that it and/or a subcontractor are out of compliance with an applicable Apprenticeship Training Program Agreement. The SCA may assess liquidated damages until such time that the Contractor and/or its subcontractor(s) are again covered under NYS-approved Apprenticeship Training Program Agreements. The amount of special liquidated damages is agreed upon by and between the Contractor and the SCA because of the impracticality and extreme difficulty of fixing and ascertaining the actual damages which the SCA would sustain in said event and such amount is agreed to be in the amount of damages which the SCA or its beneficiaries would sustain and said amount shall be retained from time to time by the SCA. The Contractor shall perform the work in a diligent and timely manner. Liquidated damages will be assessed against the Contractor for any delay beyond the scheduled completion date. The amount of liquidated damages is agreed upon by and between the Contractor and the SCA because of the impracticality and extreme difficulty of fixing and ascertaining the actual damages which the SCA or its beneficiaries would sustain as a result of any delay by the Contractor in achieving Beneficial Occupancy and/or Substantial Completion and/or Final Completion within the times specified in the approved Schedule or any extension thereof. Liquidated damages may be assessed and/or retained from time to time by the SCA, and may be assessed and/or retained by the SCA against the Contractor and/or its Surety Company regardless of whether the Contractor was defaulted or terminated by the SCA.
