The City of Peoria is requesting proposals from qualified consultants to provide materials testing and geotechnical services, including but not limited to; all personnel, materials, and equipment to perform sampling, testing, drilling, and documentation for various projects. Not with standing any other provision of this Request For Proposal, The City expressly reserves the right to: (1) Waive any immaterial defect or informality: or (2) Reject any or all proposals, or portions thereof, or (3) Reissue a Request For Proposal. The term of any resultant contract shall commence on the first day of the month following the date of award and shall continue for a period of one (1) year thereafter, unless terminated, cancelled, or extended as otherwise provided herein. No provision in this document or in the Consultant's offer shall be construed, expressly or by implication, as waiver by the City of any existing or future right and/or remedy available by law in the event of any claim of default or breach of contract. The failure of the City to insist upon the strict performance of any term or condition of the contract or to exercise or delay the exercise of any right or remedy provided in the contract, or by law, or the City's acceptance of and payment for materials or services, shall not release the Consultant from any responsibilities or obligations imposed by this contract or by law, and shall not be deemed a waiver of any right of the City to insist upon the strict performance of the Contract. The Offeror shall not contact or ask questions of the department for which the requirement is being procured. Questions should be submitted in writing when time permits. The purchasing agent may require any and all questions be submitted in writing at the Buyer's sole discretion.
