Hot Asphalt in Place to Include Milling and Patching (For Overlaying or Patching Existing Pavement) Bidders needing clarifications should fax or email questions as soon as possible. All questions must be sent prior to noon on Thursday, February 29, 2024 unless unavoidable to avoid changing the bid response date according to MS State Code 31-7-13. Only questions which change the scope of the bid documents will be considered for addendum. Addenda will be sent to all bidders, if or when necessary until two working days prior to the bid openings. Any addenda necessary within two working days of the bid opening will require the bid date to be set back to a date not less than five (5) working days after the date of the last addendum, according to Mississippi Code 31-7-13. For that reason, bidders are encouraged to investigate this bid and ask questions within the first week of receiving the bid. Withdrawal of Bids Prior to Bid Opening: A bid may be withdrawn before the opening date by submitting a written request to the Procurement Department. If time allows the bidder may submit a new bid. Bidder assumes full responsibility for submitting a new bid before specified bid time. DeSoto County reserved the right to withdraw a request for bids before the opening date. Withdrawal of Bids After Bid Opening: Bidder agrees that its offer may not be withdrawn or cancelled by the vendor for a period of ninety (90) days following the date and time designated for the receipt of bids unless otherwise stated in the bid and/or specifications. Certified Check or Bid Bond for five percent (5%) of total bid payable to DESOTO COUNTY must accompany each proposal. The awarded bidder must provide a Performance and Payment Bond referenced in this packet. Electronic submissions will require the bidder to deliver their Certified Check or Bid Bond separately prior to the bid opening. The party awarded the bid must submit, within ten (10) days of the bid award, and before beginning the work or signing a contract, a performance bond in an amount equal to one hundred percent (100%) of the total amount of the bid. Said performance bond shall be made out in favor of DeSoto County, Mississippi and issued by a Surety company qualified and licensed to do business in the State of Mississippi and acceptable to DeSoto County, Mississippi. The foregoing notwithstanding, the intent is for the contractor to comply with and satisfy Miss. Code. Ann. 31-5-51 and any provision herein shall be construed to insure compliance with said code section. Payment Bond In accordance with MS Code Ann. Sec. 31-4-41, DeSoto County will requires the posting of a payment bond in a form satisfactory to the County. The party awarded the bid must submit, within ten (10) days of the bid award, and before beginning the work or signing a contract, a payment bond payable in an amount not less than one hundred percent (100%) of all work subcontracted and conditioned for the prompt payment of all persons supplying labor or material used in the prosecution of the work under said contract and for protection against claims for payment of labor and materials by those subcontractors. Said payment bond shall be made out in favor of DeSoto County, Mississippi and issued by a Surety company qualified and licensed to do business in the State of Mississippi and acceptable to DeSoto County, Mississippi.
