For Furnishing Approximately 540,000 Pounds Hot-pour Ready Mix Joint Sealant The Small Business Enterprise Goal (including SBE) is waived. Each Bid must be on the form prescribed by the Commission and must comply with the terms and conditions set forth in all of the documents provided with this Bid Invitation. The award of the Contract, if any award be made, will be to the lowest responsive and responsible Bidder therefor whose Bid complies with all the prescribed requirements. The Commission reserves the right to reject any and all Bids and to waive minor technicalities or minor irregularities. A bid guaranty/performance bond is not required for this bid invitation. All Bids must be on the form prescribed by the Ohio Turnpike and Infrastructure Commission ("Commission"). The blank spaces in the Bid Form must be filled in correctly by the Bidder, where indicated and the Bidder must state the price for which the Bidder proposes to furnish the unit of materials or equipment for which Bids are solicited. If the Bid Form solicits Bids for more than one (1) such unit, the total extended price, based upon the number of such units, shall also be stated. In case the unit price and extension do not agree, the unit price shall govern, and the Commission is authorized to correct all erroneous extensions. The Bidder shall sign the Bid Form correctly. If an individual makes the Bid, the name and post office address must be shown. If made by a partnership or joint venture, the name and post office address of each member of the partnership or joint venture must be shown. If made by a corporation, the Bid must show the name of the state under the laws of which the corporation was chartered. B. Furnishing of Addenda: The Commission reserves the right to issue Addenda to this Invitation. A copy of each addendum (if any) will be furnished by the Commission to each person who furnishes their email address to purchasing@ohioturnpike.org. The Commission will make every effort to furnish the addendum at least seventy-two (72) hours prior to the Opening of Bids, excluding Saturdays, Sundays and legal holidays. The Bidder shall execute and return with its Bid an acknowledgement of any addendum issued. The Bidder should check the Commission's website, where all addenda are listed. Bids may be rejected if they show any alteration of form; make any additions not called for; are made conditionally; are incomplete; or are submitted with erasures or irregularities of any kind. Bids may also be rejected as a result of mutual mistake(s) as to any material element or elements of the Bid. L. Qualifications of Bidders: Contracts are awarded to Bidders that are deemed the lowest responsive and responsible Bidders in accordance with section 9.312 of the Ohio Revised Code. The Commission may require any Bidder to submit evidence of qualifications as it may deem necessary, and may consider any evidence available to it of the financial, technical, and other qualifications and abilities of the Bidder. The Commission will not award a Contract to a Bidder that, in its opinion, is not fully qualified on the basis of financial resources and responsibility, possession of adequate plant, personnel, experience, and past record of performance to perform the obligations to be undertaken competently and without delay. Bid Validity: Bids are valid for sixty (60) calendar days after Bid Opening during which time the Commission shall either award or reject Bids. If no action is taken during the sixty (60) calendar day period, the Bids shall become invalid. N. Rejection of Bid by Commission: If the lowest Bidder is not responsive or responsible, the Bidder shall be rejected, and the Commission's General Counsel or designee shall notify the Bidder in writing by ordinary mail and electronic mail of the finding and the reasons for the finding. O. Notice of Intent to Award: The Commission shall notify the apparent successful Bidder that, upon satisfactory compliance with all conditions precedent within the time specified, the Bidder will be awarded the Contract, through the issuance of a Purchase Order. The Commission reserves the right to rescind any Notice of Intent to Award. P. Questions and Inquiries Concerning Bid or Contract: If a Bidder has a question or inquiry concerning the Bidding Documents or concerning any technical requirements relating to the equipment or services to be furnished, inquiry should be made to (purchasing@ohioturnpike.org). Responses will be provided to all Bidders communicating an interest in the Bid Invitation. Inquires may be made up until the day prior to Bid Opening, subject, however, to the provisions contained in the Instructions to Bidders (Part 2) at Section B concerning the furnishing of Addenda and Section J covering the Opening of Bids. If the Contract has been awarded, all inquiries should be directed to the Commission's Chief Engineer, at the Commission's Administration Building (440) 234-2081. Q. Reservation of Rights: The Commission reserves the right to: reject any and all Bids; to seek other Bids; and to waive minor technicalities or minor irregularities noted in a Bid submitted when in the best interest of the Commission. Under no circumstances will the Commission be responsible for any costs incurred by any Bidder submitting a Bid in response to this Invitation. The term of the Contract to be entered into between the Commission and the successful Bidder shall be one (1) year from the date of issuance of the Purchase Order, and continue until all estimated quantities totaling the aggregate approximate quantity are accepted by the Commission, and any deposits are returned to the Commission, but shall remain in effect until the end of the calendar month in which the term would otherwise expire. Delivery is required within fourteen (14) days after receipt of a notification to ship.
