Renovation of an educational facility in Winchester, Virginia. Completed plans call for the renovation of a educational facility.

BUILDING AREA: 275,000 SF The intent of this Invitation for Bid (IFB) is to obtain the services of a qualified Vendor to furnish labor, equipment, and materials necessary to replace rooftop mechanical units at Daniel Morgan Middle School in accordance with the contract plans and specifications prepared by 2RW Consultants, Inc. Requests for information related to this Invitation should be directed to: Kevin McKew Capital Projects Coordinator (540) 667-4253 E-mail address: mckewk@wps.k12.va.us Contractors are required to pay wages to laborers and mechanics at a rate not less than the prevailing wages specified in a wage determination made by the Secretary of Labor. Wage determinations can be found for Frederick County, VA at SAM.GOV. Federal form WH-347 should be submitted with each pay request for work completed. The work to be performed shall consist of providing all labor, equipment, and materials necessary to service to replace rooftop mechanical units at Daniel Morgan Middle School. The selected contractor shall be responsible for all mechanical, electrical, and structural work associated with the replacement of the rooftop units, and coordinating with other owner-contracted vendors for associated work, including drywall, painting, ceiling replacement, and roof patching. Bond Notes: Bid Guarantee shall be made payable to Owner, in an amount of five percent (5%) of the bidder's maximum bid price and in a form of a certified or cashier's check drawn on a bank chartered under the laws of the Commonwealth of Virginia; payable to Winchester Public Schools, or a Bid Bond issued by a surety having registered resident agents in Virginia. The Bid Guarantee of the successful bidder will be retained until such bidder has executed the Agreement and furnished the required Contract Security, whereupon it will be returned. If the successful bidder fails to execute the agreement and furnish the required Contract Security within fifteen (15) calendar days of the Notice of Award, Owner may annul Notice of Award and the Bid Guarantee of the bidder will be forfeited. Performance and Payment Bonds will be required of the Successful bidder, each in an amount equal to one hundred percent (100%) of the amount of the Contract, conditioned upon the faithful performance of the Contract and to the payment in full to all persons furnishing labor, materials, equipment, etc., for and in connection with the work to be performed under the Contract. Liquidity Damages: liability for unpaid wages; liquidated damages. In the event of any violation of the clause set forth in paragraph (b)(1) of this section, the contractor and any subcontractor responsible therefore shall be liable for the unpaid wages. In addition, such contractor and subcontractor shall be liable to the United States (in the case of work done under contract for the District of Columbia or a territory, to such District or to such territory), for liquidated damages. Such liquidated damages shall be computed with respect to each individual laborer or mechanic, including watchmen and guards, employed in violation of the clause set forth in paragraph (b)(1) of this section, in the sum of $500.00 for each calendar day on which such individual was required or permitted to work in excess of the standard workweek of forty (40) hours without payment of the overtime wages require by the clause set forth in paragraph (b)(1) of this section. Withholding for unpaid wages and liquidated damages. Winchester Public Schools shall upon its own action or upon written request of an authorized representative of the Department of Labor withhold or cause to be withheld, from any moneys payable on account of work performed by the contractor or subcontractor under any such contract or any other Federal contract with the same prime contractor, or any other federally-assisted contract subject to the Contract Work Hours and Safety Standards Act, which is held by the same prime contractor, such sums as may be determined to be necessary to satisfy liabilities of such contractor or subcontractor for unpaid wages and liquidated damages as provided in the clause set forth in paragraph (b)(2) of this section. Owner Rights: WPS reserves the right to reject all or any part of any bid, waive informalities, and award the contract to the lowest responsive and responsible bidder to best serve the interest of WPS. Contract award will be made to the lowest responsive and responsible bidder based on total cost. WPS reserves the right to reject all or any part of any bid, waive informalities, and award the Contract to the Contractor it deems best to serve the interests of WPS. Unless all bids are cancelled or rejected, WPS reserves the right granted by 2.2-4318 of the Code of Virginia to negotiate with the lowest responsive, responsible bidder to obtain a contract price within the funds available whenever such low bid exceeds the available funds. Negotiations with the low bidder may include both modifications of the bid price and the specifications/scope of work to be performed. WPS reserves the right to require immediate removal of any Contractor employee from WPS service it deems unfit for service for ANY reason, not contrary to law. This right is non-negotiable and the Contractor agrees to this condition by accepting this Agreement. Further, WPS may, from time to time, make inspections of the work performed under the Contract. Any inspection by WPS does not relieve the Contractor of any responsibility in meeting the Contract requirements. Failure to submit a proposal on the official WPS form provided for that purpose may be a cause for rejection of the proposal. Modification of or additions to the General Terms and Conditions of the solicitation may be cause for rejection of the proposal; however; WPS reserves the right to decide, on a case by case basis, in its sole discretion, whether to reject such a proposal. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document.
