Bidders may submit questions in writing to the Municipality no later than 11:00 A.M. on March 20, 2024 The Township assumes no responsibility for the loss or the non-delivery of any bid sent to it prior to the bid opening. Each bid shall be accompanied by a bid guarantee (in the form of a certified check, bank cashiers check or bid bond of an amount equal to at least ten percent (10%) of the total bid, but not to exceed $20,000.00, payable to the Township of West Orange), and a Consent of Surety. The Consent of Surety shall be bound to furnish a performance bond as required in the Instructions to Bidders. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1.1 et seq. Bidders shall also be required to comply with all other requirements as set forth in the Instructions to Bidders. Pursuant to N.J.S.A.19:44A-20.27, a business entity that has received in any calendar year $50,000 or more in public contracts with public entities, must file an annual report with the Election Law Enforcement Commission (ELEC). All Bidders are advised and acknowledge their responsibility to file an annual disclosure statement of political contributions with the New Jersey Election Law Enforcement Commission (ELEC) pursuant to N.J.S.A. 19:44A-20.27 if they receive contracts in excess of $50,000 from public entities in a calendar year. Bidders are responsible for determining if filing is necessary. Additional information on this requirement is available from ELEC at 888-313-3532 The Township intends to award this contract to the lowest responsible bidder whose bid is responsive and responsible. The Township reserves the right to consider the bids for sixty (60) days after receipt thereof, and further reserves the right to reject any and all bids in accordance with N.J.S.A. 40A:11-13.2, and waive minor immaterial informalities, and/or take action as may be in the best interest of West Orange, all in accordance with applicable law.
