Prices to be effective on date Board awards bid. This bid, by mutual agreement of each party, may be extended for additional one-year periods. The Board reserves the right to reject any or all bids, waive defects, and to accept the bid which in their opinion is most advantageous to the Road Commission. The successful bidder shall be subject to the provisions of the Bay County Road Commission Purchasing Policy. The Bay County Road Commission reserves the right to award an alternate bid as a backup supplier to the awarded low bidder. The purpose and intent of this alternate bid award is to protect the Bay County Road Commission from the need to rebid should the primary awarded supplier fail to comply as follows: Should the primary awarded supplier fail to continually meet the Bay County Road Commission specifications, fail to have adequate supplies and quantities as required and/or fail to have adequate equipment to deliver tailgate spread or stockpiles as determined by the Bay County Road Commission General Superintendent, consideration shall be given to bidders location, haul routes, material quality, and needs as determined by the General Superintendent. The General Superintendent shall be responsible to determine if the materials supplied are acceptable for Bay County Road Commission use and shall initiate any change of supplier. Should an alternate bid have to be used, the primary awarded supplier shall pay the Bay County Road Commission the cost difference between their bid and the cost of the alternate bid used.
