It is the policy of the City that an employee, officer, or agent of City may not participate in any manner in the bidding, awarding, or administering of contracts in which they, or a member of their immediate family, their business partner, or any organization in which they serve as an officer, director, trustee, or employee, has a financial interest. The successful proposer must comply with all provisions of the Americans with Disabilities Act (ADA), the Equal Employment Opportunity Act (EEOA), and all rules and regulations promulgated thereunder. By submitting a proposal, the successful proposer agrees to indemnify the City from and against all claims, suits, damages, costs, losses, and expenses in any manner arising out of, or connected with, the failure of the Company, its subcontractors, agents, successors, assigns, officers, or employees to comply with the provisions of the ADA, EEOA, or the rules and regulations promulgated thereunder. All bids must be firm and not subject to increase, unless specified within the provisions of this Request for Proposals (RFP) and mutually agreed upon by the City and the proposer. All proposers are expected to sign the City's Independent Contractor Agreement, a copy of which is included in this RFP. If you are unable to sign the Independent Contractor Agreement or if you require changes to any of the terms or conditions contained in the Independent Contractor Agreement, then you MUST include with your response an explanation of which term(s) are unacceptable or must be revised. PROJECT SPECIFIC REQUIREMENTS A. Mowing Contract #1 based on 18 mows annually per contract terms with the exception of one location to be mowed semi-annually. B. Spraying Contract #2 based on 10 sprays annually per contract terms C. Note all requirements and information contained in the Contract Mowing and Spraying Specifications. D. The mowing contractor shall provide all required mowing, trimming and edging services along with at the listed sites. All areas are to be mowed to a height of three and one half inches (3 1/2") unless otherwise indicated. E. Each proposal which includes a bid on spraying contract #2 should include a copy of the bidder's valid Pesticide Applicators License, with a sub classification of H and L, from the North Carolina Department of Agriculture, which allows the use of Pesticides in public right-of-ways (H) as well as ornamental and turf pest control (L). If the bidder has the L sub classification, but not the H, he should show proof with the bid that the Pesticide Applicators test for sub classification H has been taken and passed. Subcontracting the pesticide spraying to a licensed applicator is allowed. Such a bidder should submit with their bid the subcontractor's pesticide applicators license number and a copy of an executed agreement to use that pesticide subcontractor for this contract. F. WITH THE EXCEPTION OF PESTICIDE SPRAYING, NO SUBCONTRACTING IS ALLOWED ON THESE CONTRACTS. The penalty for unauthorized subcontracting is immediate termination.
