The work includes reconstruction of water mains utilizing plant fabricated pipe and other appurtenant materials, installed for conveyance of potable water. The work includes thereplacement of existing facilities as may be specified in the contract. City reserves the right to issue addendums to the RFB documents prior to the Bid Due Date in order to modify and/or clarify the scope of work and/or agreement terms. All written addendums issued become a part of the RFB documents. The Contractor shall be informed as to the nature of the Work; the character, quality, and quantity of the materials required; the conditions under which the Work is to be performed, the conditions for Work with existing features, conditions of the grounds, and other relevant matters which will affect the Work. No extras shall be allowed as a result of the Contractor's misunderstanding of the extent of scope of the Work, or as a result of failure to inspect the sites and conduct a thorough investigation Each Bid shall include cash, a bidder's bond, cashier's check, or certified check payable to the City of Rochester, 4000 East River Road NE, Rochester MN 55906, in an amount equal to five percent (5%) of the total bid price. In the event the successful bidder fails to enter into a Contract within 30 working days after acceptance by the City, said cash, bidders bond, cashier's check, or certified check shall be forfeited to the City as liquidated damages. The bond shall also be on surety's company letterhead and submitted with the proposal. Bids will not be accepted without bid security. Upon award, performance and payment bonds satisfying the requirements of Minnesota statute 574.26 shall be required. Each bond shall cover 100% of the contract price and be issued by a surety having a rating of not less than B+ in the latest edition of A.M. Best's Rating Guide and authorized to do business in Minnesota. Bonds must be in a form acceptable to the City Attorney. The Rochester Public Utility Board reserves the right to reject any and all Bids and to accept the Bid or Bids, in whole or in part, considered in the best interests of the City of Rochester. In order to determine which Bid best serves the interest of the City of Rochester, consideration will be given to prices, delivery, stated exceptions to these Bid Documents and any other factors which may affect operating and/or capital cost. Neither receipt of Bidder's bid nor failure to reject Bidder's bid shall impose any legal obligation on City. Bidders may request clarification/questions regarding any of the requirements of this RFB, including terms and conditions to which the City of Rochester will consider an addendum reflecting changes that may more accurately reflect the conditions of the market.
