Questions and Inquiries from Bidders must be received by the Spotsylvania County Procurement Division by Friday, March 15, 2024 at noon. Questions must be emailed to Sylvia Dyson, Sr. Procurement Officer, at SDyson@Spotsylvania.VA.us. The County is not responsible for verbal clarification of information provided by parties other than staff of the Procurement Division. The successful Contractor shall provide one (1) 36 foot by 56 foot, permanently installed new modular building with three (3) private office spaces, two (2) single gang restrooms, one (1) common space area, and one (1) kitchen Area, and one (1) locker room area. Notwithstanding anything to the contrary contained herein, Contractor expressly agrees that A/E/CM has no authority to make any changes in the scope, quantities of work, or to the terms and conditions of the Contract Documents. To the extent the A/E/CM directs the Contractor with regard to any such changes, Contractor assumes sole risk for any costs, expenses and/or damages incurred by Contractor, Owner and any other affected party, for following such direction, unless such direction was approved by County, in writing, in advance of performance of the work associated with the direction by the A/E/CM. Contractor expressly waives any right to claim for additional compensation or additional time for performance of the Work to the extent it fails to comply with the obligations of this Section 2.3. If the Contractor's Proposed Change Order is rejected by the Owner as being within the scope of the Work required by the Contract Documents the Owner may, at its sole option and discretion, direct the Contractor to perform the Work which is the subject of the said Proposed Change Order; the Contractor shall then promptly proceed with said Work. Nothing herein shall excuse the timely performance by the Contractor of the Work because any Proposed Change Order is pending. If notice of any change affecting the general scope of the Work or the provisions of the Contract Documents (including, but not limited to, Contract Price or Contract Times) is required by the provisions of any Bond to be given to a surety, the giving of any such notice shall be the responsibility of Contractor and not Owner. The amount of each applicable Bond will be adjusted to reflect the effect of any such change. Each Bid over $100,000 must be accompanied by (1) Letter of Credit; or (2) a Cashier's Check or a Certified Check from the Bidder in an amount not less than five percent (5%) of the Bid, made payable to the County of Spotsylvania; or (3) a Bidder's Bond on the Bid Bond Form provided herein or on a similar form which in every respect materially complies with said Bid Bond Form, in the amount of five percent (5%) of his/her Bid. The successful Bidder shall furnish a Performance Bond in an amount equal to one hundred percent (100%) of the Contract Sum as security for the faithful performance of this Contract, and also a Labor and Material Payment Bond in an amount not less than one hundred percent (100%) of the Contract Sum, as security for the payment of all persons performing labor and furnishing materials under this Contract. The Performance Bond and the Labor and Material Payment Bond shall be in separate instruments acceptable to the County, in accordance with State law and shall be delivered to the County not later than the date of execution of the Contract. The surety shall be such surety company or companies that are acceptable to the County and that are authorized to transact business in the Commonwealth of Virginia. The successful Bidder, upon his/her failure or refusal to execute the Contract within ten (10) days after he/she has received notice of the acceptance of his/her Bid, shall forfeit to the County the security deposited with his/her Bid, as liquidated damages for such failure or refusal. The county expressly reserves the right to reject the Bid of any Bidder if such record discloses that such Bidder, in the opinion of the County, has not properly performed such contracts; or has habitually and without just cause neglected the payment of bills; or has otherwise disregarded his/her obligations to Subcontractors, material men, suppliers or employees; or has had, in the sole and exclusive judgment of County, a poor safety record from prior projects performed within or outside of the County.
