The City of Fort Myers is seeking a qualified and responsible Construction, Engineering, & Inspection firm to provide observation and documentation services. The City of Fort Myers, incorporated on March 24, 1886, is located in Lee County, Florida and has a staff of approximately 1000 employees serving a population of approximately 93,000 permanent residents. The City encompasses approximately 50 square miles. The City functions as a Council / Manager form of government. Thomas Edison was one of Fort Myers' early inhabitants and a formational figure in the City's development. Fort Myers became known as "The City of Palms" as a result of Edison's deep respect for nature. Through his effort and determination, the royal palms lining historic McGregor Boulevard were imported and planted resulting in today's beauty and majesty. His best friend Henry Ford shared Edison's enthusiasm in Fort Myers and became a homeowner and frequent visitor. The history associated with Edison and Ford along with the building boom in the late 1800's and early 1900's left a legacy and history unique to Fort Myers. The cobblestone downtown and historic districts have retained much of their charm and proper preservation measures are in place to ensure that charm will be treasured for generations to come. The City of Fort Myers owns and operates a Public Water Supply (PWS) system that includes the use of raw groundwater sourced from the Upper Floridan Aquifer (UFA) from a collection of raw water production wells, a single Water Treatment Plant (WTP) that employs a reverse osmosis treatment process, three ground storage tanks (GST) at the WTP, two Water Storage Facilities (WSF) located in the communities, and a potable water distribution system. In 2022, the City hired an engineering firm to design an upgrade to the WTP including, but not limited to: expansion of existing capacity from 12 to 15 MGD, upgrade of the existing electrical system including backup power generation and improvements to the SCADA system. The following design deliverables are included in this solicitation: Final Water Treatment Plant RO Treatment Plant Improvement Project Preliminary Design Report (August 21, 2023) and the 60% Design Plans and Specifications. The design of the project initiated in November 2022 and is currently 60% complete. A Construction Manager-at-Risk(CMAR) has also been selected and is under contract for pre-construction services. Owner Rights: The City reserves the right to accept or reject any or all submittals and to waive minor irregularities and technicalities. The City's decision in such matters is final. City reserves the right to reject any and all Solicitations, to waive any and all informalities and to negotiate contract terms with the Successful Respondent, and the right to disregard all nonconforming, non-responsive, unbalanced or conditional responses. Also, City reserves the right to reject the submission of any Respondent if City believes that it would not be in the best interest of the City to make an award to that Respondent, whether the Solicitation is not responsive, or the Respondent is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by City. The City reserves the right to accept or reject the request for a price increase within thirty (30) days. If the price increase is approved, the price will remain Respondent for the renewal period for which it was requested. Liquidity Damages: In the event of any violation of the clause set forth in paragraph (i) of this section the Individual/Respondent/Contractor/Consultant and any subcontractors responsible therefor shall be liable for the unpaid wages. In addition, such Contractor and subcontractors shall be liable to the United States (in the case of work done under contract for the District of Columbia or a territory, to such District or to such territory), for liquidated damages. Such liquidated damages shall be computed with respect to each individual laborer or mechanic, including watchmen and guards, employed in violation of the clause set forth in paragraph (i) of this section, in the sum of $27 for each calendar day on which such individual was required or permitted to work in excess of the standard workweek of forty hours without payment of the overtime wages required by the clause set forth in paragraph (i) of this section. Question Submission Deadline:March 11, 2024, 5:00pm Bond Notes: Upon filing of the Formal Written Protest, the Respondent shall post a bond, payable to the City in an amount equal to five percent (5%) of the total Solicitation or Ten Thousand Dollars ($10,000.00), whichever is less. Said bond shall be designated and held for the payment of any costs that may be levied against the protesting party by the City, as the result of a frivolous Protest. Said security shall be in the form of a cashier's check on a national or state bank, money order, or a protest bond executed by the Respondent and a qualified Surety authorized to do business in the State of Florida, and acceptable to the City.
