The intent of this Request For Proposals and resulting contract is to obtain services to support CCMUA's OpenEnterprise based Supervisory Control and DATA Acquisition System. Firms responding to this Request for Proposals should have extensive experience and a knowledgeable background and qualifications in the provision of the services described herein. Despite any language contained herein to the contrary, this Request for Proposals does not constitute a bid and is intended solely to obtain competitive proposals from which the CCMUA may choose a contractor(s) that best meet(s) the CCMUA's needs. It is the CCMUA's intent that no statutory, regulatory, or common law bidding requirement applies to this Request For Proposals. The CCMUA intends to award this contract pursuant to N.J.S.A. 40A:11-5(1)(a)(1). Official CCMUA RFP documents are available from the CCMUA as described herein at no cost to the vendor. Potential proposers are cautioned that they are proposing at their own risk if a third party supplied the RFP document that may or may not be complete. The CCMUA is not responsible for third party supplied RFP documents. Term of agreement shall be one year commencing on/about May 20, 2024 through May 19, 2025, with two one year options to renew. The CCMUA may terminate the agreement for any reason upon thirty (30) days written notice to the firm. In this event, the CCMUA shall only be responsible for payment up to the effective date of termination. Any questions regarding this Request For Proposals must be made in writing to Len Gipson, Director of O&M lgipson@ccmua.org with copy to Kris Bligh, Chief IT Dept kbligh@ccmua.org. All questions must be sent by email no later than 3:00PM on March 5, 2024. Questions received after this date and time will not be addressed. The CCMUA reserves the right to reject all proposals received in accordance with NJ law. The following Scope of Services describes the specific tasks to be performed by the Consultant. If the Consultant believes that the project can be enhanced in any way by the addition of other tasks, such information should be included in the proposal. All activities are on an as-needed basis. The CCMUA intends to award a consulting services contract through this RFP to perform the following scope of work: A. Manufacturer's Extended Hardware Warranty Support Services: Provide hardware warranty and on-site diagnostic support for a period of three (3) years from the effective date of the Purchase Order, or the written notice to proceed for the EMERSON manufactured 33XX, ControlWave, and Control WaveMicro based equipment. Include repair and replacement of any parts that fail under normal usage. The list of hardware is included in Attachment #1. It is noted that the 33xx hardware is obsolete and failure recovery of the 33xx hardware would require a migration to the ControlWave hardware as further defined within this specification. B. Manufacturer's Licensing, Software Upgrade, Update, and Support Services: Provide manufacturer's licensing, licensed software support, update, and upgrades that include OpenEnterprise Servers, Workstations, and the complete suite of OpenBSI software tools, drivers and utilities, etc. The list of minimum Licenses to be provided and maintained is included in Attachment #1. C. Training and/or Application Configuration Support Services: Provide on-site support for up to three weeks per year. This support includes any reconfiguration and/or modification of OpenEnterprise Configuration and Programming as requested by the CCMUA, and any associated training that may be required. D. Corrective Maintenance (A and B above): Shall include on-site and off-site maintenance on the hardware and software. The services to be provided under this contract will include but not be limited to the following: 1. Systems Maintenance: a. Corrective Maintenance will be provided by the respondent to keep all equipment in operation with as little downtime as possible. The respondent will have service personnel on site or via remote connection, no more than 24 hours after notification by the CCMUA by telephone. Unscheduled corrective maintenance services are to be available seven (7) days per week twenty-four (24) hours per day, as required by the CCMUA to keep the equipment in good working order. The successful respondent b. Vendor shall provide a telephone number through which emergency services can be requested 24 hours a day, seven days a week. c. In those instances where the respondent elects to utilize CCMUA owned spare parts to correct system operational failures, the respondent shall make the necessary arrangements to repair/replace the defective part(s). All such parts shall be repaired to the Original Manufacturer's mechanical and electrical operational specifications, at no charge, and returned to full working order to the owner's stores within forty-five (45) days of removal. d. Unserviceable parts will be replaced by new parts or, at the bidder's option by parts equivalent to new in performance. Such replacement parts will be furnished on an exchange basis. Defective parts which have been replaced become the property of the bidder. All replacement parts shall be warranted for 90 days or the remaining period of this contract, whichever is longer. e. The respondent will provide all necessary mechanical and electrical test equipment required in order to perform the maintenance services as required by this agreement. The CCMUA will furnish as available, for the use of the bidder's maintenance personnel, a working space containing working facilities, store space, heat, light, ventilation, electric power and outlets for testing purposes. The respondent shall have full and free access to the system and facility, so long as it does not hinder normal CCMUA operations or affect the ability of the CCMUA to meet discharge permits as determined by the CCMUA. Any scheduled maintenance services by the respondent must be approved in advance by CCMUA. The CCMUA shall not be liable for test equipment, tools, spare parts, etc., owned by the respondent and stored on-site which are damaged, lost or stolen. f. In the event that alterations, modifications, or changes to the system shall be required by the CCMUA, they shall be submitted to the respondent by the CCMUA for review and comments. Exceptions taken to any such changes as required by the CCMUA must be specifically noted in writing to the CCMUA from the respondent within one (1) week from the receipt of such information by the bidder, unless such other time is mutually agreed to by both parties. The CCMUA will comply, when possible, with such written exceptions, but the CCMUA will make the final determination regarding overall acceptability of any required alterations/modifications. If at any time, any such changes or alterations create a safety hazard or interfere with the normal and satisfactory operations and maintenance of the equipment, the respondent shall provide written notice to the CCMUA recommending that such safety hazard or interference be promptly corrected. g. The respondent shall document all repairs, part replacements, time expenditures, component modifications, wiring changes, etc., at the time of service (scheduled or emergency). This record document shall be submitted by equipment reference number and description to the CCMUA's IT Manager upon completion of the service. h. All repairs to maintain all system components operation shall be in accordance with the manufacturer's specifications. i. Unlimited technical/operational consultation by telephone on system problems, software problems, software modifications, etc., must be provided. Consultation shall be available during normal business hours. j. The respondent shall provide emergency service 24 hours a day, seven days a week. A response will be provided via phone or email within 2 hours of receipt of an emergency notification. 2. Software Maintenance a. The respondent shall be responsible for maintenance of all original and application software as part of the system at the beginning of this agreement. If troubleshooting services are deemed required for "defective" software, the respondent shall either troubleshoot or isolate and correct the problem or reload the configured software that is known to be functional to resolve the problem. If the cause of a software problem is attributed to improper software modifications instituted by the CCMUA, the respondent may invoice the CCMUA. The scope of this work includes fine-tuning, debugging, and documentation support to have the software operate as a system in accordance with applicable functional and performance specifications. Respondent must provide documentation that they are authorized and licensed by EMERSON to perform work on the OpenEnterprise and Ionics software. b. Any software changes, enhancements, upgrades and updates must be documented in a continuous ongoing log. 3. Additional Off-Site Services Any services performed beyond the scope of this bid shall be approved by the CCMUA prior to the service(s) being performed. Approved services performed beyond the scope of this bid which are performed off-site are to be billed on an hourly rate. This is subject to the procurement laws of the state of New Jersey for related or unrelated work. 4. Additional On-Site Services Any services performed beyond the scope of this bid shall be approved by the CCMUA prior to the service(s) being performed. Approved services performed beyond the scope of this bid which are performed on-site are to be billed on a daily rate. This is subject to the procurement laws of the state of New Jersey for related or unrelated work. E. Provide all necessary labor, hardware and software support to upgrade existing 33XX RTU to ControlWave Micro RTU as identified and approved by the CCMUA. Existing 33XX hardware removed shall be turned over to the CCMUA to be utilized as spares. The upgrades shall include the Main Plant, Pumping Stations, and Metering Stations. The method of Contractor Selection has not been Determined at this time.
