Proposals may be hand delivered to the CMCMUA by placing the Proposal in the drop box located to the left of the front entrance of the CMCMUA's Administration Building, 1523 Route 9 North, Cape May Court House or may be submitted via certified mail or overnight delivery. The Authority assumes no responsibility for Proposals received after the designated time and date, and will return late Proposals to the Proposer unopened. Purpose of RFP In accordance with the New Jersey Local Public Contracts Law N.J.S.A.40a:11-5(1)(s), the Authority is permitted to award contracts as related to the marketing of recyclable materials and disposal of Universal Waste (UW) and unregulated Household Hazardous Waste (1-11-1W), without public bidding. The Authority must however comply with the New Jersey Pay-to-Play Law (N.J.S.A.19:44A-20.4) which requires that all contracts awarded to a single vendor over $17,500.00 must be awarded through a fair and open process. Pursuant to these requirements, the CMCMUA is seeking a Contractor who shall supply all of the necessary materials, equipment and personnel needed to perform all identification, segregation, consolidation, packaging, labeling, transportation, recycling and disposal services as required for paints and paint-related products as well as any quantities of Universal Wastes or exempt Household Hazardous Wastes requiring pickup on the designated days as set forth herein. The Authority is seeking to qualify vendors who meet the requirements of the RFP. During the coming year, the Authority may contract with one (1) or more qualified vendor(s) to perform the services as specified in this Request for Proposal. The maximum expenditure for these recycling services shall not exceed $78,000.00 among the qualified vendors. Project Background Paint and Paint Related Materials Program: In November 2004, the Authority initiated a project to recycle/dispose of water-based paints, oil-based paints, and finishes on a routine basis. Under this program, latex paints, oil based paints, stains, boat bottom paints, enamels, varnishes, shellacs, lacquers, polyurethane, wood and masonry sealers, wood preservatives, and aerosol paint cans are received from residents, schools, public and other unregulated generators for recycling/disposal. This program prevents the uncontrolled introduction of these materials into the environment and to divert these potentially dangerous materials from the regular solid waste stream. The CMCMUA also receives Universal Wastes such as spent pesticides, herbicides and mercury containing devices, (i.e.: thermostats and thermometers) and other hazardous materials approved for acceptance by the Contractor, under this program. In accordance with NJDEP Universal Waste rules, CMCMUA constructed a suitable pole building with an impermeable concrete base and appropriate features to keep accumulated materials dry and provide a containment area for any spills that may occur. The Authority conducts all activities in accordance with local, state and federal regulations and statutes. Summary of Work The Cape May County Municipal Utilities Authority ("Authority"/"CMCMUA"), is seeking the services of qualified Contractor(s) to provide all necessary personnel and equipment needed to perform the identification, segregation, packaging, labeling, loading, weighing, transportation, recycling and disposal of all waste collected under this program. It is expected that the Contractor shall have all waste identified, segregated, labeled, weighted, packaged, loaded and transported off-site within a maximum of three (3) hours after arrival. including, but not limited to: radioactive materials, PCB's, and explosives shall be considered unacceptable. The Contractor shall be required to accept waste included under this RFP, in containers up to and including fifty-five (55) gallons in size. The Contractor, at Contractor's discretion, may accept larger containers, subject to the approval by both the CMCMUA and the Contractor. It shall be the Contractor's responsibility to make sure that all of the items picked up are acceptable. If unacceptable materials are discovered after pick-up (including but not limited to PCB's in paints, or other hazardous waste) it is the Contractor's responsibility to pay for any additional costs related to the proper handling and disposal of the unacceptable material and provide documentation to the CMCMUA concerning the nature and proper disposition of that material. If unacceptable materials are discovered by the Contractor while still at the CMCMUA site, these unacceptable items shall be: (1) kept segregated from paint and other acceptable materials; (2) dealt with by the Contractor and the CMCMUA on a case by case basis as a negotiable extenuating circumstance. Estimated Quantity The actual quantities to be received are not known, however, during the period of January 2023 through December 2023, the Paint Recycling Program accepted approximately 40,110 pounds of latex paint, 7,700 pounds of paint related products, 400 pounds of aerosol cans and 0 pounds of other UW and exempt HHW. During the same period, vendor pickup of all materials amounted to approximately 25 tons. This data is only provided as background information for the proposer and is not to be interpreted as a guaranteed amount of waste paint and other waste products accumulated by the CMCMUA Paint Recycling Program. Although quantities may change, unit price per pound must remain firm. Proposal documents will be made available to attendees for inspection after all Bids and/or RFPs scheduled for the day have been opened Proposers are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., and of N.J.A.C. 17:27-1 et seq. This Request for Proposal is being solicited through a fair and open process in accordance with the requirements of N.J.S.A. 19:44A-20.4 CAUSES FOR REJECTING PROPOSALS A. Proposals may be rejected for any of the following reasons: 1. Any or all Proposals pursuant to the criteria enumerated in N.J.S.A. 40A:11-13.2; 2. If more than one Proposal is received from an individual, Firm or Partnership, Corporation or Association under the same name; 3. Multiple Proposals from an Agent representing competing Proposers; 4. The Proposal is inappropriately unbalanced; 5. If the Successful Proposer fails to enter into a contract within twenty-one (21) days, Sundays and holidays excepted, or as otherwise agreed upon by the Parties to the Contract. In this case, the Owner, at its option, pursuant to N.J.S.A. 40A:11-24b may accept the Proposal of another Proposer. METHOD OF CONTRACT AWARD A. Unless otherwise stated in the Technical Requirements and/or the Proposal Form, the length of the Contract(s) shall be for a period of one (1) year (twelve consecutive months) from the date of execution of the Contract(s), or as necessary to complete all work stipulated in the Contract documents. Contracts in excess of twelve (12) consecutive months shall be subject to the availability and appropriation annually of sufficient funds in the year in which it takes effect. B. In evaluating Proposals, the Owner will consider whether or not the Proposal complies with the RFP. C. The Owner may conduct such investigations as the Owner deems necessary to assist in the evaluation of any Proposal within the prescribed time. D. The Owner shall award the Contract or reject all Proposals within sixty (60) days after the Proposals are publicly opened, except that the Proposals of any Proposers who consent thereto may, at the request of the Owner, be held for consideration for such longer periods as may be agreed. All Proposal prices and conditions shall remain firm during the evaluation period. E. The Successful Proposer will be required to execute the Contract within ten (10) days (Sunday and holidays excluded) after receipt of notification that the Contract is ready for signature. F. If the Successful Proposer shall fail to execute the Contract as foresaid, then the Owner may, by its option, determine the Proposal and acceptance to be null and void. G. the effective date of this contract shall be the date upon which the Executive Director (or designee) of the Cape May County Municipal Utilities Authority executes the contract. Contract Award The Authority will award Contracts to Qualified Vendors. Highest ranking score will determine the use of Vendors along with the Authority to meet the needs of the CMCMUA. Contract Period The effective date of each Agreement shall be the date upon which the Executive Director of the Cape May County Municipal Utilities Authority or designee has signed the Agreement and shall continue in effect for one (1) year or when the expenditures reach the awarded Contract amount. As permitted in N.J.S.A. 40A:11-15, this Contract also contains two (2) one (1) year renewal options. The options must be agreed upon by both parties and will be subject to the same terms and conditions as the original Contract. This Contract shall be subject to availability and appropriation annually of sufficient funds in the year which it takes effect.
