Site work and paving for a mixed-use development in Kawkawlin, Michigan. Completed plans call for site work for a road / highway; for paving for a road / highway; sidewalk / parking lot; and sidewalk / parking lot.
A contract for HMA overlay of 0.59 miles of westbound US-10 located in Williams Township, Bay County Michigan. Having carefully examined the site of the proposed work and being fully informed in regard to the conditions to be met in the prosecution and completion of the work, and having read and examined the Contract Documents, the undersigned agrees to be bound accordingly and proposes to furnish all the materials, labor, tools, power, transportation and construction equipment necessary for the satisfactory and complete construction of: US-10 overlay project, In full accordance with and conformity to the proposal and specifications for this work now on file, at and for the following named prices entered herein of this contract proposal Question Deadline 03/18/2024 at 9:00 AM ET All bids must be accompanied by a Bid Guaranty in favor of the Bay County Road Commission. Bidders have the following options to provide the amount of the Bid Guaranty as specified in this proposal; 1. An electronic bid bond, properly completed and verified by Surety 2000 or Tinubu Surety (formerly SurePath); or 2. A properly completed paper bid bond; or 3. A money order, certified or cashier's check on an open, solvent bank in favor of the "Board of Bay County Road Commission." b. Bid Bond If the Bidder chooses to guaranty the bid using a bid bond. Bid Guaranty Submittal For Electronic Bids The Bid Guaranty shall be received by the Bay County Road Commission before the Bid opening date and time in order to fulfill this bidding requirement. Any bids not accompanied with a Bid Guaranty by the bid opening date and time will be considered non-responsive. The methods for providing the required Bid Guaranty for electronic bids are as follows; A. An electronic bid bond, properly completed and verified by Surety 2000 or Surepath; or B. Submittal of a properly completed paper bid bond or a money order, certified or cashier's check to the Bay County Road Commission Offices, located at 2600 E Beaver Road, Kawkawlin, Michigan 48631. The Bid Guaranty shall be in a sealed envelope with contents clearly identified, on the outside of the envelope, with the Bidders Name, Project Name and Project Number. The right to accept any proposal, to reject any or all proposals, and to waive defects in proposals is reserved by MDOT or the Board of County Road Commissioners, of the County of Bay. Prior to submitting his bid, the bidder shall examine the proposal, specifications and related documents and make a personal examination of the site(s) in order to acquaint themselves with the conditions under which they will be required to work. The bidder shall make all the investigations necessary to thoroughly inform themselves regarding facilities for the delivery of materials and equipment as may be required for their construction operations. If the Contractor fails to do this, no plea for ignorance of existing conditions shall be accepted. If failures or omissions in fulfilling all requirements of said contract result, the Contractor shall be responsible for corrections. On this basis, no claims will be accepted for extra compensation or extensions of time. The successful bidder shall furnish surety bonds with sureties acceptable to the Board. One bond equal to one hundred percent (100%) of the contract price as security for the faithful performance of the contract and one equal to one hundred percent (100%) of the contract price as security for the payment of all labor, materials, and supplies used in the work and protection of the Board from all liens and damages arising from the work. The Contractor shall be required to guarantee the work a period of two years from the date of acceptance (final payment) against defects or failures in the work that they have performed. The firm, corporation, or individual name of the bidder must be on the proposal. In case of a corporation, the title of the officer signing must be stated and satisfactory evidence must be attached that the person signing has the authority to sign the proposal for the corporation. In case of a partnership, the signature of at least one of the partners must follow the firm name. MDOT or the Board shall have the right to hold all bids for a period of thirty (30) calendar days after the opening thereof, unless otherwise stated in the supplemental specifications, during which time all bids shall be rejected or the lowest responsible bidder shall be awarded the contract. The successful bidder shall furnish the required bonds and insurance and execute the contract within ten (10) calendar days after receipt of award and of the contract documents. The bid bond/deposit of all except the successful bidder will be returned after the contract has been awarded. If the bidder, to whom the contract has been awarded, shall refuse or neglect to execute the contract and properly secure the same within ten (10) calendar days after written notice by the Board or MDOT to do so, the amount of the bond/deposit shall be forfeited and retained as liquidated damages for such neglect or refusal. All work and material furnished as part of this project shall conform to the 2012 Standard Specifications for Construction adopted by the Michigan Department of Transportation or the special provisions contained herein. The opening and reading of the proposal shall not be construed as an acceptance of the Bidder as a responsible Bidder. The Board reserves the right to determine the responsibility of the Bidder from their knowledge or from other sources. If requested by the Board, the low bidder, in order to determine whether they are a responsible bidder, shall be required to furnish to the Board the following information: An itemized list of equipment available for use on the project. An authenticated financial statement, dated within 60 days prior to the bid date. Any additional information that may satisfy the Board that the Bidder is adequately prepared to fulfill the contract. Any one or more of the following causes may be considered sufficient for the disqualification of a bidder and the rejection of their bid: The total cost of the project, as a result of the bidding process, is such that it is not in the BCRC's best interest or could be considered fiscally irresponsible to proceed. Evidence of collusion among the bidders. Lack of competency as revealed by either financial, experience, or equipment statement as submitted. Lack of responsibility as shown by past work, judged from the standpoint of workmanship and progress. Failure to comply with any of the Board's requirements as contained in the Proposal. The Bay County Road Commission, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 USC 2000d to 2000d-4a and Title 49, Code of Federal Regulations, Department of Transportation, Sub Title A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of gender, disability, race, color, or national origin in consideration for an award.
