Gravel Stone Crushing Strait Pit: 20,000 (twenty thousand) tons of crushed material The material to be crushed shall be run of bank gravel. While some oversized rocks may be interspersed in the material, for the most part, the material shall be less than 14" in any dimension (i.e. length, width, height). The contractor shall be responsible to furnish all equipment, equipment operators, labor and ancillary items necessary to load, crush, weigh and stockpile material on site. Wherein a contractor and Steuben County are both parties to a contract involving a public works project with an aggregate dollar value of two hundred and fifty thousand dollars ($250,000.00) or more; said contract shall be understood, by all parties, to include "the provisions that all of the contractor's and sub contractors laborers, workers, and mechanics shall be certified as having successfully completed a ten (10) hour OSHA approved course in construction safety and health." Such a requirement having been mandated by the New York State Laws of 2007, chapter 282. Liquidated Damages: Accordingly, instead of requiring any such proof, the County and the awardee agree that as liquidated damages for delay (but not as a penalty) the awardee shall pay the County one hundred dollars ($100.00) for each and every calendar day that expires beyond the time period described in the Project Timeframe clause of this bid solicitation.
