Renovation of an educational facility in Yuba City, California. Completed plans call for the renovation of a educational facility.
The contractor shall provide all labor, equipment and non-owner supplied materials to install the new roof system over the properly prepared substrate. Project will include a liquid applied restoration over the existing single ply membrane, a new standing seam metal roof and a new two ply modified bitumen roofing system. Owner to provide Garland roofing materials. Provide all labor, equipment and non owner supplied materials to install the new roof system over the properly prepared substrate. 3 1. Tear off existing roof system (s) to the structural deck. 2. Locate and repair/replace all areas of damaged substrate prior to installing new roof system. Roofing manufacturer must have representative inspect structural deck prior to any materials being installed. 3. Install tapered polyisocyanurate insulation crickets. 4. Install 2-ply modified bitumen roofing system per specification. 5. Install Title 24 compliant roof coating. 6. Install new 22 gauge coping cap with wind cleat. The Bidder must list hereinafter the name and location of each Subcontractor who will be employed, and the scope of Work that each will perform if the Contract is awarded to the Bidder. The Bidder acknowledges and agrees that under Public Contract Code section 4100, et seq., it must clearly identify the name and location of each Subcontractor who will perform Work or labor or render service to the Bidder in or about the construction of the Work in an amount in excess of one-half of one percent (1/2 of 1%) of the Bidder's total Bid. As to any Work for which the Bidder fails to list a Subcontractor, the Bidder agrees to perform that portion itself or be subjected to penalty under applicable law. In cases of suspension, partial or complete termination, or at the discretion of the District, the District reserves the right to unilaterally approve a deductive Change Order to reduce scope of work or perform work with other forces or its own forces. Liquidated Damages: Time is of the essence for all Work to be performed. It is hereby understood and agreed that it is and will be difficult and/or impossible to ascertain and determine the actual damage that the District will sustain in the event of and by reason of the Contractor's delay; therefore, the Contractor shall forfeit to the District the following sum(s) ("Liquidated Damages"): a. It is hereby understood and agreed that neither the total cumulative Liquidated Damages amount nor any portion of the Liquidated Damages amount are penalties. b. The District may deduct Liquidated Damages from money due or that may become due to the Contractor under this Agreement. The Contractor's forfeiture of Liquidated Damages to the District, and the District's right to retain Liquidated Damages, are as indicated in Government Code section 53069.85 and as indicated herein and in the General Conditions. c. Liquidated Damages are automatically and without notice of any kind forfeited by the Contractor upon the accrual of each day of delay. Neither the District's failure or delay in deducting Liquidated Damages from payments otherwise due the Contractor, nor the District's failure or delay in notifying the Contractor of the forfeiture of Liquidated Damages, shall be deemed a waiver of the District's right to Liquidated Damages. d. The Contractor and the Surety shall be liable for and pay to the District the entire amount of Liquidated Damages including any portion that exceeds the amount of the Contract Price then held, retained or controlled by the District. e. Liquidated Damages shall be in addition, and not in lieu of, the District's right to charge the Contractor for the District's cost of completing or correcting items of the Work. Request for Information by By Friday, March 1, 2024 by 4:00 p.m. Owner Rights: The District's Board reserves the right to reject any and all bids and/or waive any irregularity in any bid received. If the District awards the Contract, the security of unsuccessful Bidder(s) shall be returned within sixty (60) calendar days from the time the award is made. Unless otherwise required by law, no Bidder may withdraw its bid for ninety (90) calendar days after the date of the Bid opening. Bids shall be clearly written without erasures or deletions. The District reserves the right to reject any Bid containing erasures or deletions. The District reserves the right to reject any or all bids, including without limitation the right to reject any or all nonconforming, non-responsive, unbalanced, or conditional bids, to re-bid, and to reject the Bid of any Bidder if the District believes that it would not be in the best interest of the District to make an award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by the District. The District also reserves the right to waive inconsequential deviations not involving price, time, or changes in the Work. For purposes of this paragraph, an "unbalanced bid" is one having nominal prices for work item(s) that represent substantive work and/or overly-enhanced prices for nominal work item(s). Bond Notes: As security for its Bid, each Bidder shall provide with its Bid form: A bid bond issued by an admitted surety insurer on the form provided by the District, Cash, or ,A cashier's check or a certified check, drawn to the order of the Yuba City Unified School District, in the amount of ten percent (10%) of the total bid price. This bid security shall be a guarantee that the Bidder shall, within seven (7) calendar days after the date of the Notice of Award, enter into a contract with the District for the performance of the services as stipulated in the Bid. The successful Bidder shall furnish to the District a 100% Performance Bond and a 100% Payment Bond if it is awarded the contract for the Project.
