The successful bidder shall commence work with the issuance of the Notice to Proceed and per the project schedule referenced below. The District has established a liquidated damage rate of $1,000.00 per calendar day for each and every calendar day that the work remains fully uncompleted or unaccepted by the District. Such bidder's security must be in an amount not less than ten percent (10%) of the maximum amount of bid, as a guarantee that the bidder will enter into the proposed Contract, if the same is awarded to such bidder, and will provide the required performance and payment Bonds, insurance certificates and any other required documents. In the event of failure to enter into said Contract or provide the necessary documents, said security will be forfeited. Within 10 days after notification of the Award of Contract, the successful bidder or bidders will be required to furnish, simultaneously with execution of the Contract, a Labor and Material Payment Bond and a Faithful Performance Bond in the form required by the District, each in an amount equal to one hundred percent (100%) of the Contract Price. The Board reserves the right to reject any or all Bids, and further reserves the right to waive any informalities or irregularities in the Bids or in the bidding. Completion Date-Liquidated Damages: Time is of the essence in this Contract. Contractor must commence work on the project upon receipt of the Notice to Proceed and the project must be completed as per Paragraph 4 of Specification Section 00300, Bid Form. Failure to complete the project on time will subject the successful bidder to liquidated damages as set forth in the liquidated damages provision set forth in the General Conditions.
