No bids may be withdrawn after the scheduled time for the bid opening. Base Bid: The work generally consists of: Removal of 450 Feet of 96" CMP and replacement with 96" Fiberglass reinforced pipe (FRP) with surface restoration. The contract(s) will be awarded based on the OWNER's best interests. The award will be based on the lowest cost combination of responsive, responsible bids, on the Base Bid and various Schedules, Alternatives, and Additive Alternate, as applicable, selected by the OWNER. Contract Time: Base Bid: Segment 1 must be substantially complete and ready for OWNER's use and pre-final inspection by July 26, 2024. All construction schedules must be finally complete and ready for final payment within (30) calendar days of Substantial Completion. Liquidated Damages: The CONTRACTOR shall pay the OWNER $2,000 for each calendar day or part of a day that expires after the time specified for Substantial Completion of any construction schedule until the Work is substantially complete ach bid will be submitted on the basis of a cash payment for work. Each bid must be accompanied by a Bidder's Bond in the amount of five percent (5%) of the bid, payable to the OWNER. All bonds shall comply with the appropriate provisions of the North Dakota Century Code, as amended. The bid bond and a copy of the contractor's license or certificate of renewal shall be in a separate envelope attached to the outside of the bidding documents. All bids must be sealed. Bid and Bid Bond must be executed by a principal. Signatures by other than a president, vice president, or CEO, must be accompanied by sufficient evidence (duly executed meeting minutes, resolution, power of attorney, etc.) to indicate that the signatory has the authority to bind the company or organization. No bid will be read or considered which does not fully comply with the above provisions as to Bond and Licenses, and any deficient bid submitted will be resealed and returned to the Bidder immediately. The OWNER reserves the right to hold all bids and bid securities for a period not to exceed 30 days and to hold the three low bids and bid securities for a period not to exceed 60 days from the date of the bid opening. The OWNER may, at its sole discretion, release any Bid and return the Bid security prior to the end of these periods, waive any formality in any bid, and reject the bid of any party who has been delinquent or unfaithful in the performance of any former contract with the OWNER Question Deadline 03/18/2024 Questions received less than ten (10) days prior to the date for opening of Bids may not be answered. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda which will be posted to QUESTCDN.
