City of Omaha is requesting bids from qualified companies, herein called Bidder, Contractor, Vendor, Supplier, or other pronouns used in their place, for all work and/or goods set forth in the specifications. SCOPE: The project consists of grinding existing pavement, concrete base repair, asphalt resurfacing, and utility adjustments Anticipated Notice to Proceed date: Monday, 7/15/2024 This bid does not have an SEB reserve. This project requires submission of an Economic Equity and Inclusion Plan (EEIP). This project qualifies for Apprentice utilization. Contractor should attach Apprenticeship Incentive Form (AIF) with their bid submission to utilize this provision. Requirement for Bid Bond: The surety company issuing the bid bond should be licensed by the State of Nebraska and listed on the current edition of Circular 570 of the United States Department of the Treasury. Acceptable substitutes for a bid bond: a certified check, an official bank check, a cashier's checks drawn on a national bank or a bank chartered under the laws of the state, payable to City of Omaha, or lawful money of the United States, or a United States Government Bond (negotiable). LETTERS OF CREDIT ARE NOT AN ACCEPTABLE SUBSTITUTE FOR A BID BOND AND WOULD BE CAUSE FOR REJECTION OF BID. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all parties recorded as having received the Bidding Documents. A Bid must be accompanied by Bid security made payable to Owner in an amount of 5 percent of Bidder's maximum Bid price (determined by adding the base bid and all alternates) and in the form of a certified check, an official bank check, cashier's check drawn on a national bank or a bank chartered under the laws of the State of Nebraska, payable to the City or a duly executed Bid bond (on the form included in the Bidding Documents) issued by a duly licensed corporate surety meeting the requirements of Paragraphs 6.01 and 6.02 of the General Conditions. The Bid security of the apparent Successful Bidder will be retained until Owner awards the contract to such Bidder, and such Bidder has executed the Agreement, furnished the required contract security, and met the other conditions of the Notice of Award, whereupon the Bid security will be released. If the Successful Bidder fails to execute and deliver the Agreement and furnish the required contract security and certificates of insurance within 14 calendar days after the Notice of Award, Owner may consider Bidder to be in default, annul the Notice of Award, and the Bid security of that Bidder will be forfeited. Such forfeiture shall be Owner's exclusive remedy if Bidder defaults. The Bid security of other Bidders that Owner believes to have a reasonable chance of receiving the award may be retained by Owner until the Effective Date of the Agreement or 61 days after the Bid opening, whereupon Bid security furnished by such Bidders will be released. Provisions for liquidated damages, if any, for failure to timely attain a Milestone, Substantial Completion, or completion of the Work in readiness for final payment, are set forth in the Agreement. The successful BIDDER will be required to furnish Performance and Payment Bonds .
