The work to be done consists of furnishing all materials, equipment, tools, labor, and incidentals as required by the Plans, Specifications and Contract Documents for the above-stated project. The general items of work to be done hereunder consist of cleaning and sealing street cracks from 1/8" to 1" in width, as well as all other appurtenant or related work as shown or referenced on the plans Any contract entered into pursuant to this notice will incorporate certain provisions of the State Labor Code. Compliance with the prevailing rates of wages and apprenticeship employment standards established by the State Department of Industrial Relations will be required. In accordance with Labor Code Sections 1725.5 and 1771.1, no contractor or subcontractor shall be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code or engage in the performance of any contract for public work, unless currently registered and qualified to perform public work. No bidders will be discriminated against on the basis of race, denial of family and medical care leave, religious creed (including religious dress and grooming practices), color, national origin (including language use restrictions), ancestry, physical disability or mental disability (including HIV and Aids), medical condition (cancer and genetic characteristics), genetic information, military or veteran status, marital status, gender, gender identity, gender expression, sex (which includes pregnancy, childbirth, breastfeeding and medical conditions related to pregnancy, childbirth or breastfeeding), age or sexual orientation in any consideration leading to the award of contract. Proposals must be accompanied by a proposal guarantee consisting of a certified check or bid bond payable to the CITY in the amount of ten percent (10%) of the total amount bid. Any proposal not accompanied by such a guarantee will not be considered. Both the Faithful Performance Bond and the Payment Bond shall each be for not less than one-hundred percent (100%) of the total contract amount. The Payment Bond shall remain in force until seven (7) months after the date of recordation of the Notice of Completion or Notice of Acceptance. The Faithful Performance Bond shall remain in force until one year after the date of final acceptance of the work The work shall be commenced on a date to be specified in a written Notice to Proceed from the CITY and shall be completed within Forty Five (45) calendar days from and after said date. It is expressly agreed that except for extensions of time duly granted by the CITY, time shall be of the essence. If a bidder to whom a contract is awarded fails or refuses to execute the contract documents or furnish the required insurance policies and bonds as set forth in those documents, the proposal guarantee shall be forfeited to the CITY. The proposal guarantees all bidders will be held until the successful bidder has properly executed all contract documents. The contract documents call for monthly progress payments based upon the engineers' estimate of the percentage of work completed. The CITY will retain 5 percent of each progress payment as security for completion of the balance of the work. At the request and expense of the successful bidder, the City will pay the amounts retained upon compliance with the requirements of Public Contract Code, Part 5, Section 22300, and the provisions of the contract documents pertaining to Substitution of Securities. The CITY reserves the right to reject any or all bids, to waive any irregularity, to accept any bid or portion thereof, and to take all bids under advisement for a period of sixty (60) days. At the time of contract award, the prime contractor shall possess a valid Class A contractor's license and/or a combination of Class "C" specialty contractor's license(s) sufficient to perform the work.
