All proposals must be accompanied with a bid bond, cashier's check or a certified check drawn on a national or state bank in the amount of five (5) percent of the total bid amount and made payable to HARRIS COUNTY MUD NO. 144 hereinafter referred to as the Owner, as a guarantee that the bidder will enter into a contract or execute the required bonds within ten (10) days of the Notice Of Award. Bids submitted without a cashier's check or certified check will not be considered. Project consists of rehabilitation of existing sanitary sewer including: pipebursting, CIPP and point repair methods. If erasures or other changes appear on the forms, each such erasure or change must be initialed by the person who signs the bid submittal. After bids have been opened and prior to making an award, the Owner reserves the right to require the most responsible, responsive Bidder to furnish a statement of the Bidder's financial resources, construction experience and organization for the work contemplated. The Owner shall have the right to take such steps deemed necessary to determine the ability of the Bidder to perform the work. The Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The right is reserved to reject any bid where an investigation of the evidence or information submitted by such Bidder does not satisfy the Owner that the Bidder is qualified to carry out properly the terms of this Contract. All bid securities will be returned to the respective bidder within ten (10) days after the bid opening, except those which the Owner elects to hold until the successful bidder has executed the Contract and furnished performance and payment bonds in the amount of 100 percent of the total contract price from an approved surety company holding a permit from the State of Texas to act as a surety according to the latest list of companies holding certificates of authority from the Secretary of the Treasury of the United States, or other surety which is acceptable to the Owner. The surety must have a minimum rating of at least "B+" from Best Key Rating. The person executing the payment and performance bonds must be a licensed Texas local recording agent and such licensing must be recorded in the files of the State Board of Insurance and must be authorized by the surety company to execute payment and performance bonds on behalf of the company in the amount required for the contract and such authorization must be recorded in the files of the State Board of Insurance. The Owner shall return the successful bidder's bid surety within ten (10) days after execution of the Contract and the Owner's acceptance of the other required bonds. It is the declared and acknowledged intention and meaning of these Contract Documents to provide a Proposed SANITARY SEWER REHABILITATION PHASE 1. All work shall be done and all materials shall conform strictly in accordance with the rules and regulations of the Harris County Municipal Utility District No. 144, City of Houston, Harris County, the State of Texas, and the United States of America.
