Each Contractor shall be permitted to examine the site, familiarize themselves with the full nature and extent of the work, ask questions, obtain answers to the SOW, and obtain clarifications of the Contract. Only businesses that meet the statutory requirements set forth in State Finance and Procurement Article, 14-50114-505, Annotated Code of Maryland, and certified in eMaryland Marketplace Advantage for the Small Business Reserve Program are eligible for award of a contract. The Department reserves the right to purchase replacement materials in the open market. Contractors failing to promptly replace materials lawfully rejected shall be liable for any excess price paid for the replacement, plus applicable expenses, if any.
