Hickory Hills Pump Station 1. Modify existing remote telemetry unit (RTU) to provide data communication from Hickory Hills Standpipe (new) to Hickory Hills Pump Station and Hughes RWD#2 WTP Office. Equipment required for modifications shall be provided by the Integrator. 2. Create a communication subnetwork for the Hickory Hills Standpipe and Pump Station by adding new data radio modems and updating the human machine interface (HMI). 3. HMI shall be integrated with the existing programmable logic controller (PLC) to integrate the new telemetry subnetwork with the existing radio telemetry network. The integration shall provide data communication for the new subsystem to the existing system, including the Hughes RWD#2 office. 4. Pump "run" status conditions shall be indicated for each individual pump. Pump status shall be indicated on the HMI. 5. Pump "fail" status conditions shall be indicated for each individual pump locally. A pump "fail" condition shall be determined if a pump fails to start after a field adjustable time delay once the pump is "called" to run. Pump status shall be indicated on the HMI. Bond Notes: The General Conditions, as may be modified by the Supplementary Conditions, sets forth Owner's requirements as to performance and payment bonds, other required bonds (if any), and insurance. When the Successful Bidder delivers the executed Agreement to Owner, it must be accompanied by required bonds and insurance documentation. A Bid must be accompanied by Bid Security made payable to Owner in an amount of 5 percent of Bidder's maximum Bid price (determined by adding the base Bid and all alternates) and in the form of certified check, bank money order, or a Bid Bond issued by a surety meeting the requirements of Paragraph 6.01 of the General Conditions. Such Bid bond will be issued in the form included in the Bidding Documents. Owner Rights: Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Without assigning any reason therefore, and to make the awards in the best interest of the Owner, Owner also reserves the right to waive all minor Bid informalities not involving price, time, or changes in the Work. Bids are solicited and a Contract award will be made pursuant to the Public Competitive Bidding Act of 1974 as amended. Owner will reject the Bid of any Bidder that Owner finds, after reasonable inquiry and evaluation, to not be responsible. Liquidity Damages: Provisions for liquidated damages, if any, for failure to timely attain, Substantial Completion, are set forth in the Agreement. Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed within the Contract Times, as duly modified. The parties also recognize the delays, expense, and difficulties involved in proving, in a legal or arbitration proceeding, the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty): 1. Substantial Completion: Contractor shall pay Owner $500 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified above for Substantial Completion, until the Work is substantially complete. 2. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Times (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $1000 for each day that expires after such time until the Work is completed and ready for final payment.
