Design Requirements 1. Design, fabrication, materials, and erection shall conform to requirements of AWWA D100, latest edition, except as modified herein. 2. Tank capacity to be measured capacity between low-capacity level and overflow. Tank shall be a standpipe type design. 3. Construct tank of welded steel according to standard design of manufacturer experienced in design and fabrication of such structures. 4. Tank shall be designed to safely withstand loads and forces acting separately or together. To the fullest extent permitted by Laws and Regulations, Owner shall indemnify and hold harmless Contractor, Subcontractors, and Engineer, and the officers, directors, members, partners, employees, agents, consultants, and subcontractors of each and any of them, from and against all claims, costs, losses, and damages (including but not limited to all fees and charges of engineers, architects, attorneys, and other professionals, and all court, arbitration, or other dispute resolution costs) arising out of or relating to a Hazardous Environmental Condition, provided that such Hazardous Environmental Condition (1) was not shown or indicated in the Drawings, Specifications, or other Contract Documents, identified as Technical Data entitled to limited reliance pursuant to Paragraph 5.06.B, or identified in the Contract Documents to be included within the scope of the Work, and (2) was not created by Contractor or by anyone for whom Contractor is responsible. Nothing in this Paragraph 5.06.I obligates Owner to indemnify any individual or entity from and against the consequences of that individual's or entity's own negligence. Bond Notes: I hereby certify that, in the event of being awarded a Contract, I will provide a Performance Bond for 100% of the contract amount. Each Bidder shall accompany his original Bid, filed with the Hughes County RWD #6, with a certified or Cashier's Check on a solvent bank located in Oklahoma, or a Bidder's Bid Bond, in the amount of 5 percent of the amount Bid, as a guarantee of his ability to perform the contract Bid upon, and that he will enter into a written contract with the Owner to perform said work and/or furnish said materials in accordance with said Plans and Specifications, and furnish the required bonds according to the Public Competitive Bidding Act of 1974. Construction, Maintenance and Statutory Payment Bonds in the amount of 100 percent of the contract price are required for this Project. These bonds must be obtained from a Corporate Surety licensed in Oklahoma and approved by the Owner and Consulting Engineer. The Bidder shall state in the Proposal the name and address of the Surety or Sureties who will sign this Bond in case the contract is awarded. The Maintenance Bond required will guarantee the repair of all damage due to improper materials or workmanship for a period of 1 year after the acceptance of the work by the Owner. Owner Rights: The Owner reserves the right to correct any non-material clerical errors in the bidding as allowed under Oklahoma Law. The Owner reserves the right to reject any and all Bids in accordance with the Oklahoma Public Competitive Bidding Act of 1974. Conditional bids shall not be accepted. The Owner reserves the right to reject any Bid if the evidence submitted by, or investigation of such Bidders fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the contract and to complete the Work contemplated therein. Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder. Owner also reserves the right to waive all informalities not involving price, time, or changes in the Work and to negotiate Contract terms with the Successful Bidder. The time for completion is 210 calendar days. Liquidated damages: Liquidated damages will be $500 per calendar day. Provisions for liquidated damages, if any, for failure to timely attain a Milestone, Substantial Completion, or completion of the Work in readiness for final payment, are set forth in the Agreement.
