Maintenance of landscaped areas and maintenance, repair and inspection of irrigation and pump system, fort weaver road, hanakahi street to vicinity of fort weaver interchange, fort weaver road at h-1 freeway to fort weaver road at ewa beach road, district of ewa, island of oahu. The scope of work consists of furnishing all labor, materials, tools, and equipment necessary for the maintenance of certain designated landscaped areas, including applicable planter boxes within the highway right-of-way and maintenance, repair, and inspection of irrigation and pump system. PERFORMANCE OF WORK shall be amended by adding the following to the end of the subsection: "The Contractor shall perform work satisfactorily in the judgment of the Director during the contract period. If it appears at any time that the work contracted to be performed is not satisfactory, the Director may require the Contractor to furnish and place in operation such additional force and equipment as the Director shall deem necessary to bring the work up to satisfactory status. In case the Contractor fails to comply after ten (10) working days from the date of receipt of such a written order from the Director, the Director may employ a working force and equipment and charge the Contractor for the reasonable cost thereof including depreciation for equipment and or he may terminate the contract. Bond Notes: Performance bond is required for the First year of this project. Bid and payment bonds are not required For this project. Owner Rights: The State reserves the right to reject any or all proposals and to waive any defects in said proposals in the best interest of the public. Contact Person: Vuong, Tong T LIQUIDATED DAMAGES shall be amended by adding the following to the end of the subsection: A. Liquidated Damages for routine and preventative Maintenance and Inspection of Irrigation System. Plants which die to irrigation failure will be considered to have died due to Contractor's negligence, invasive plants, insects, disease or malpractice shall be replaced with the same species, spread and height at the Contractor's expense within 4 weeks of notification from the Engineer. The Contractor shall pay liquidated damages to the Department for the replacement values of plants not replaced within the 4-week period after notification from the Engineer. Below is the schedule of liquidated damages. Liquidated Damages. Refer to Section 8.6.B Maintenance and Inspection of Irrigation and Pump System (routine/preventive), of the Special Provisions for the liquidated damages that the State shall be assessing the Contractor for failure to provide satisfactory and timely Maintenance and Inspection of Irrigation and Pump System (routine/preventive) service and for failure to respond to trouble calls.
