Site work and paving for a sidewalk / parking lot in Clarksville, Tennessee. Completed plans call for site work for a sidewalk / parking lot; and for paving for a sidewalk / parking lot.

The work to be performed (Work) includes the construction of approximately 6,000 linear feet of concrete sidewalks along Peachers Mill Road and 1,000 linear feet of concrete sidewalks along Hazelwood Road. The work includes traffic control along with all necessary materials, labor and equipment to complete the Work as set out more fully in the Specifications. The time for completion of the work is 120 days. Bids will be received for a single prime Contract. Bids shall be on a Lump Sum basis with Add Alternates as indicated in the Bid Form. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. Bid security in the amount of 5% of the bid price shall be furnished in accordance with the Instructions to Bidders. Bidding shall be in accordance with Tennessee law, to include Tennessee Code Annotated, Title 62, Chapter 6. Bidders must be licensed contractors as required by TN Code Ann. Sections 62-6-103 and 62- 6-112. Bidders are required to provide evidence of compliance with Title 62, Chapter 6 before any bidders bid may be considered. Pursuant to TN Code Ann. Section 62-6-119, each contractor / bidder applying to bid for the prime contract and for any masonry contract where the total masonry portion of the construction project exceeds one hundred thousand dollars ($100,000.00), materials and labor, electrical, plumbing, heating, ventilation, and air conditioning contracts, is required to place his / her bid in a sealed envelope showing the bidders name, contractor license number, license expiration date, and license classification, and for electrical, plumbing, heating, ventilation and air conditioning contracts and for each vertical closed loop geothermal heating and cooling project, the company name, TN Department of Environment and Conservation license number, classification, and the expiration date of same, on the outside of the envelope, except when the bid is in an amount less than twenty-five thousand dollars ($25,000.00). Only one (1) contractor in such classification may be listed. Prime contractor bidders who are to perform the masonry portion of the construction project which exceeds one hundred thousand dollars ($100,000.00), materials and labor, the electrical, plumbing, heating, ventilation and air conditioning must be so designated upon the outside of the envelope. Bids not conforming to these legal requirements are void shall not be opened or considered. Bids less than twenty-five thousand dollars ($25,000.00) may contain only the name of the contractor on the outside of the envelope. Upon opening the envelope, if such bid is in excess of twenty-five thousand dollars ($25,000.00), the same shall be automatically disqualified and shall not be considered. Additionally, the name of the person or entity bidding must match the name of the license listed on the outside of the bid envelope. Vendors shall follow Tenn. Code Ann. 62-6-119 (2016) which states in part: 62-6-119. Bid documents - Penalties. (a) Any person or entity preparing plans, specifications or any other documentation for inclusion in an invitation to bid or comparable bid document including any electronic bidding documents, shall reference this chapter in such documentation and include a specific statement informing the invited bidder that it is necessary for such bidder to be properly licensed at the time of the bid and provide evidence of compliance with the applicable provisions of this chapter before such bid may be considered. (b) The person or entity involved in the preparation of the invitation to bid or comparable bid documents, including any electronic bid documents, shall direct that the following information be written upon the bid envelope or provided within the electronic bid document: (1) The name, license number, expiration date thereof, and license classification of the contractor applying to bid for the prime contract; (2) The name, license number, expiration date thereof, and license classification of the contractor applying to bid for the masonry contract where the total cost of the materials and labor for the masonry portion of the construction project exceeds one hundred thousand dollars ($100,000); (3) The name, license number, expiration date thereof, and license classification of the contractor applying to bid for the electrical, plumbing, heating, ventilation, or air conditioning contracts except when such contractors portion of the construction project is less than twenty-five thousand dollars ($25,000); (4) For each vertical closed loop geothermal heating and cooling project, the company name, department of environment and conservation license number, classification (G, L or G,L) and the expiration date, except when the geothermal portion of the construction project is in an amount less than twenty-five thousand dollars ($25,000); (5) Prime contractor bidders who are to perform the masonry portion of the construction project which exceeds one hundred thousand dollars ($100,000), materials and labor, the electrical, plumbing, heating, ventilation or air conditioning or the geothermal heating and cooling must be so designated; and (6)Only one (1) contractor in each of the classifications listed above shall be written on the bid envelope or provided within the electronic bid document. (c) Failure of any bidder to furnish the required information shall void such bid and such bid shall not be considered. Upon opening of the bid envelope or initial opening of an electronic bid, the names of all contractors listed shall be read aloud at the official bid opening and incorporated into the bid. Prior to awarding a contract, the awarding person or entity and its authorized representatives shall verify the accuracy, correctness and completeness of the required information, and any discrepancies found in the spelling of names of bidders, transposition of license numbers, or other similar typographical errors or omissions may be corrected within forty-eight (48) hours after the bid opening excluding weekends and state-recognized holidays. No Bid may be withdrawn within sixty (60) consecutive calendar days after the bid opening date. The City of Clarksville reserves the right, as its interest may require, to reject any and/or all Bids and to waive informalities herein. Attached you will find a Drug-Free Workplace Affidavit, an Attestation of Illegal Aliens form, an Iran Divestment Act Certification, a Non-Boycott of Israel Affidavit and a copy of the Citys Contractors Safety Program. All must be filled out, signed and returned with your bid. Failure to do so shall result in your bid being rejected. ABSOLUTELY NO EXCEPTIONS. Each bidder must submit a signed Conflict of Interest form with each and every bid on all bids with the City of Clarksville at the time of that party's submission of the bid. In those cases where bids are opened by the City and the apparent low bidder for which the bid would be awarded has not done so, the City will notify that bidder that the signed Conflict of Interest form was not submitted, but that the submission of the form within two working days after the Citys notification, oral or written, or the failure to submit the form, will allow the City to further consider the bid in accordance with all other applicable rules and practices. The City will not be responsible for the bidders loss of the bid opportunity if the bidder cannot be reached by the Citys best effort for contact The City is not responsible for mail that is not delivered in a timely manner by the United States Postal Service, any delivery service (i.e. UPS, FedEx, etc.) or emails that are sent by the City that end up in a vendors spam or junk mail. All bids/proposals must be returned by the date and time specified to 1 Public Square, Suite 301, Clarksville, TN. Completed sealed responses shall be in the hands of the Purchasing Department personnel by the date and time specified or it will be considered late. It is the vendors responsibility to ensure that their bid/proposal complies with all requirements and is received by the Purchasing Department prior to the date and time of the official opening. The official time clock is on the wall in the Purchasing Department. The City will not award a bid, proposal, contract, etc. to any vendor that is in arrears to the City on a debt, contract, or judgment or who is otherwise in default to the City. More than one bid/proposal for the same work/product from an individual or entity under the same or different names will not be considered and shall result in rejection of all bids/proposals in which that bidder has an interest. Alternate bids will not be considered unless specifically called for in the bid/proposal. The City of Clarksvilles payment terms are net 30. We will not pay for any goods or services in advance of receipt and inspection. If you are unable to comply with these terms, we require that you not place a bid. Any bid or request for proposals not accepting these terms will be considered non-responsive and not acceptable. TCA 12-4-113 prohibits addenda to bid documents within less than 48 hours of a bid opening, and to require that questions concerning bid documents must be received no less than 96 hours before the bid opening date excluding weekends and legal holidays. All questions shall be in writing to the contact name provided. This shall not apply to the department of transportation contracts or any state or local agency contracts funded in whole or in part with state or federal highway funds. It is the responsibility of the vendor to check with the City to see if any addenda have been issued. The City reserves the right to reject any and all bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional bids. Owner further reserves the right to reject the bid of any bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible. The City may also reject the bid of any bidder if the City believes that it would not be in the best interest of the project/bid to make an award to that bidder. The City also reserves the right to waive all informalities not involving price, time, or changes in the work and to negotiate contract terms with the successful bidder. The City also reserves the right to reject the bid of a bidder who has previously failed to perform properly or complete on time contracts of a similar nature, or a bid of a bidder who investigation shows is not in a position to perform the contract. All purchases competitively bid shall be awarded to the lowest and best bidder taking into consideration performance on prior projects, projected timeline of any deliverables and/or the quantities of the articles to be supplied, their conformity with specifications, their suitability to the requirements of the city, and the delivery terms.
