The work included under this Project consists of furnishing all labor, materials, equipment and incidentals necessary for the construction of water mains, including pipes, valves, fittings, hydrants, and site restoration. The work is to be performed for the Jericho Water District along NYS Route 106 for National Grid. Detailed work requirements are contained in the Drawings and Specifications. The Bidder to whom the OWNER proposes to award the Contract will be required to furnish performance and payment bonds and the necessary insurance certificates as prescribed in the General Conditions and the Supplementary Conditions upon the execution of the Agreement within ten (10) days of the Notice of Award. Bidders are required to execute a non-collusive bidding certification required by Section 103-d of the General Municipal Law of the State of New York. OWNER reserves the right to reject any and all Bids and waive any and all informalities, and the right to disregard all nonconforming or conditional Bids or counter proposals. In evaluating Bids, OWNER shall consider the qualifications of the BIDDERS, whether or not the Bids comply with the prescribed requirements, and alternates and unit prices, if requested in the Bid Forms. The OWNER may consider the qualifications and experience of Subcontractors and/or Suppliers who are to furnish the items of equipment for those portions of the Work as to which the identity of the Subcontractor and/or equipment Suppliers must be submitted as specified in the Bid. The OWNER may conduct such investigations as they deem necessary to establish the responsibility, qualifications and financial ability of the BIDDERS and equipment Suppliers to do the Work in accordance with the Contract Documents to OWNER's satisfaction within the prescribed time. OWNER reserves the right to reject the Bid of any BIDDER who does not pass any such evaluation to OWNER's satisfaction. If a contract is to be awarded, it will be awarded to the lowest responsive responsible BIDDER whose evaluation by OWNER indicates to OWNER that the award will be in the best interests of the Project. If the Contract is to be awarded, OWNER will give the apparent successful BIDDER a Notice of Award within forty-five days after the day of the Bid opening. Simultaneously with delivery of the executed counterparts of the Agreement to OWNER, the apparent successful BIDDER shall deliver to OWNER the required Contract Security. The undersigned and OWNER recognize that time is of the essence of the Agreement to be executed by the undersigned (if awarded the Contract) and that OWNER will suffer financial loss if the Work is not completed within the times specified in paragraph 1 above. The parties also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by OWNER if the Work is not completed on time. Accordingly, instead of requiring any such proof, OWNER and BIDDER agree that as liquidated damages for delay, but not as a penalty, BIDDER shall pay OWNER $1,500 for each consecutive calendar day that expires after the time specified in paragraph 1 above for Substantial Completion. If BIDDER shall neglect, refuse, or fail to complete the remaining Work within the Final Contract Time or any proper extension thereof granted by OWNER, BIDDER shall pay OWNER $1,500 for each consecutive calendar day that expires after the time specified in paragraph 1 above for Final Completion and readiness for final payment until the Work is completed and ready for final payment. The undersigned BIDDER warrants and represents, if awarded the Contract, that any work order proposed herein will be substantially completed in accordance with Section 14 of the General Conditions within 45 consecutive calendar days after the date when the Contract Time commences to run as provided in Section 2 of the General Conditions, and finally completed and ready for final payment in accordance with Section 14 of the General Conditions within 15 consecutive calendar days after the date of Substantial Completion (Final Contract Time).
