Lennar Homes hereby invites Bids for the Construction of Tract 37408 & 37409 Streetlight Improvements (Project) all in accordance with the approved specifications on file at the office of the Bid Administrator, Murow Development Consultants. WORK TO BE DONE: All work to be performed shall be done in accordance with the provisions of these Contract Documents, and the applicable requirements provided in the Jurisdictional Agency's Standard and Specifications Latest Edition. All work within public right of way shall be performed within the guideline of the American Public Works Association's W.A.T.C.H. Manual. The Subcontractor shall take all necessary precautions to protect in place all overhead, underground, and surface improvements shown or not shown on the drawings including, but not necessarily limited to pole lines, pipelines, conduits, cabling, subsurface facilities, AC Pavement, concrete, sewer lines, water lines, services and meters, pumps, valves, hydrants, irrigation facilities, and any other improvements located adjacent or within areas to be improved. If existing improvements not limited to the aforementioned are removed or damaged, Subcontractor is responsible to replace in-kind. Subcontractor is responsible for any necessary potholing and all associated costs are considered included in the Contract Price. No additional compensation will be paid. All questions related to this project shall be submitted in writing through electronically. It shall be understood, however, that no interpretations will be made by telephone or email, nor will any products be considered for approval prior to award of the Contract. Changes, if any, will be made by addendum prior to opening of bids. Each Bid shall be accompanied by cash, a certified or cashier's check payable to the Contractor, or a bidder's bond, as a guaranty that the Bidder, if successful, will, within ten (10) calendar days after receiving a Notice of Award, enter into valid contract with the Contractor for the work at the prices stated in his bid. The bidder's bond shall be made payable to the Contractor and executed as surety by a corporation authorized to issue surety bonds in the State of California. Unless otherwise provided in the Invitation to Bidders, the amount of said guaranty shall be not less than ten percent (10%) of the total amount bid in the proposal. Acceptance or Rejection of Bids a. The Contractor reserves the right to reject any or all Bids received, to waive technical errors and discrepancies, or to request additional information from any or all of the respondents for the purpose of ascertaining the most qualified bidder for the work requested. b. The Contractor may make such investigation as it deems necessary to determine the ability of the Bidder to perform the work, and the bidder shall furnish to the Contractor all such information and data for this purpose as the Contractor may request. The Contractor reserves the right to reject any bid if the evidence submitted for, or investigation of, such bidder fails to satisfy the Contractor that such bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein. Conditional bids will not be accepted. c. The Bidder must be capable of performing the various items of work bid upon. Bidder may be, and where so required, required to furnish a statement covering experience on similar work, a list of machinery, plant, and other equipment available for the proposed work, and a financial statement, including a complete statement of the bidder's financial ability and experience in performing public work in general and in the manner in which pleadings in civil actions are verified. d. The Award of Contract, if it is awarded, will be to the lowest responsible Bidder whose Bid complies with all the specifications and contract documents described, with the following exceptions: i. If Awarding Body deems that acceptance of the lowest responsible Bidder is not in the best interest of the Project, it may reject all Bids and advertise for other bids; or ii. If Awarding Body determines the lowest Bidder is not responsible, it may award the Bid to the next lowest Bidder deemed responsible. e. The Contractor shall be, and is hereby constituted, the exclusive judge as to the responsibility of a Bidder, and in ascertaining the fact that the Contractor will take into consideration the business integrity, financial resources, facilities for performing the work, experience in similar operations, of the various bidders. All bidders, by submitting a bid, irrevocably accept the Contractor's authority as exclusive judge to the responsibility of a bidder. f. Bids may, at the Contractor's option, be rejected if they contain any alterations, additions, conditional or alternative bids, incomplete bids, erasures, or irregularities of any kind. g. More than one Bid from any individual, firm, co-partnership, corporation, or association, under the same or different names will not be considered. Reasonable grounds for believing that any Bidder is interested in more than one Bid for the work contemplated will cause the rejection of all Bids in which such Bidder is believed to be financially interested.
