All proposals shall include a bid bond or Bank Letter of Credit in the amount of 5% of the contract amount. Bonds: The successful bidder, simultaneously with the execution of the Contract, will be required to furnish a faithful Performance Bond in an amount equal to one hundred percent (100%) of the Contract amount, and a Labor and Material Payment Bond in the amount of one hundred percent (100%) of the Contract amount or a Bank Letter of Credit in the amount of 50% of the bid amount. The bond shall be secured from a surety company acceptable to the Owner. The City of Petoskey reserves the right to accept or reject any or all proposals and to award to the bidder whose bid best serves the interest of the City. The project commencement date is March 31, 2025. The contract completion date is May 23, 2025. TIME. The Contractor covenants and agrees that the work herein agreed to be performed shall be commenced promptly upon notice and that said work shall be carried on with dispatch, time being of essence of this agreement, and in such manner as to be fully and completely performed on or before March 31, 2025 and this shall be considered a "Calendar Day Contract". Phase I – Mitchell Street to Lake Street. Phase II Lake Street to Bay Street. The entire work of the contract (Phase I and II) is to be completed on or before May 23, 2025. The contractor shall receive either a written or verbal notice of award no later than February 18, 2025. The contractor shall provide insurance and bonds within 10 calendar days of the Notice of Award, and will receive either a written or verbal notice to proceed within 5 calendar days of the Owner receiving confirmation of the insurance and bonds. The Contractor shall begin Phase I work on or before March 31, 2025. - LIQUIDATED DAMAGES. a. Failure to Substantially Complete. The Contractor will be charged full liquidated damages for each calendar day after the specified contract time that the status of the work is such that the project is not "Substantially Complete". Reference Table 8-1, Schedule of Liquidated Damages. b. Failure to Complete on Time. The Contractor will be charged 50% liquidated damages for each calendar day after the specified contract time that the status of the work is such that the project can be "Substantially Complete", but is not totally completed, including the provisions of Article 5, Final Clean Up. Damages for failure to meet the requirements for completion of the project will not be assessed during periods of winter seasonal suspensions of work ordered by the Engineer unless otherwise shown in the proposal. Liquidated Damages for failure to "Substantially Complete" and for failure to complete on time will not be assessed simultaneously. c. Assessment of Liquidated Damages. Sums assessed as Liquidated Damages shall not be considered penalties, but as damages due the Owner from the Contractor for failure to complete the work within the specified time
