Site work, paving and outdoor lighting for a mixed-use development in Louisville, Kentucky. Completed plans call for site work for a sidewalk / parking lot; for outdoor lighting for a sidewalk / parking lot; for paving for a sidewalk / parking lot; transportation facility; transportation facility; transportation facility; and water / sewer project.

This project consists of grading, installation of storm sewer system, placement of fill, constructionofflexible pavement lighting and CCTV system for the development of a parking lot. Each sealed Bid shall be accompanied by an irrevocable Bank Letter of Credit, or satisfactoryBidBond (see Attachment #8) with good corporate surety, in a sum not less than ten percent (10%)oftheaggregate amount of the Bid, payable without condition to the Louisville Regional Airport Authority, toguarantee that if the Bidder's offer results in an Award, the Bidder will furnish all requiredbonds, insurancecertificate(s) and insurance policy(ies) within ten (10) Calendar Days after the Notice of Awardisgiven, andenter into the Contract within thirty (30) Calendar Days after the Notice of Award is given. The Authority, in accordance with the provisions of Title VI of the Civil Rights Act of 1964, 78Stat.,252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, DepartmentofTransportation, Subtitle A, Office of the Secretary, Part 21, Non-discrimination in FederallyAssistedPrograms of the Department of Transportation issued pursuant to such Act, hereby notifies all Biddersthatitwill affirmatively ensure that any contract entered into pursuant to this advertisement, DisadvantagedBusiness Enterprises will be afforded full and fair opportunity to submit Bids in response tothisinvitationand will not be discriminated against on the grounds of race, color, religion, sex, or national origininconsideration for an Award. The bidder/proposer shall make good faith efforts, as defined in Appendix Aof 49CFRPart 26,Regulations of the Office of the Secretary of Transportation, to subcontract 11.7 (11.7%) percent of thedollarvalue of the prime contract to small business concerns owned and controlled by sociallyandeconomicallydisadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as aDBE, thecontract goal shall be deemed to have been met. Individuals who are rebuttably presumedtobesociallyandeconomically disadvantaged include women, Black Americans, Hispanic Americans, NativeAmericans,Asian-Pacific Americans, and Asian-Indian Americans. Individuals who are not presumedtobesociallyandeconomically disadvantaged, and individuals concerning whom the presumption of disadvantagehasbeenrebutted, have the burden of proving, by a preponderance of the evidence, that theyaresociallyandeconomically disadvantaged. The apparent successful competitor will be required to submit informationconcerning the DBEs that will participate in the contract. The information will include: (1) thenameandaddress of each DBE; (2) a description of work to be performed by each named firm; (3) thedollar valueofwork of the contract; (4) written confirmation of the bidders commitment to use a DBEsubcontractorwhoseparticipation it submits to meet a contract goal; (5) written confirmation fromthe DBEthat it is participatingin the contract as provided in the prime contractors commitment; and (6) if the contract goal isnot met,evidence of good faith efforts as provided in 49 C.F.R Part 26. Award of the contract will beconditionedonmeeting these requirements. A certified DBE is one that is certified by the KentuckyDepartmentofTransportation. The Authority reserves the right to waive any informality in any Bid or Bid Guaranty, toreject anyand all Bids and to negotiate with any Bidder to such extent as may be necessary. The Authority has a No Contact Policy which prohibits communication or contact byBidders(s)orits representative(s) directed at members of the Authoritys Board, its employees, its consultants, or itsotherrepresentatives concerning the subject of the Bid Documents except as permitted by the BidDocuments. A. No Unauthorized Contact by Proposers. Upon the advertisement or other publicationofnotice of these Proposal Documents until such time as an Award is madewithrespectthereto, there shall be no communication or contact initiated by Proposers, potentialProposers, or their representatives directed at members of the Authoritysboard, itsemployees, its consultants, or its other representatives concerning the subject oftheProposal Documents, except as permitted by these Proposal Documents. Communicationwith the designated POC is allowed. B. Unrelated Contact. If the Authority currently contracts with a Proposer, this policyshallnot prohibit communications between the Authority and such Proposer totheextent theyrelate to the existing contract and not the subject of the Proposal Documents. C. Contact by the Authority. This policy shall not prohibit Authorityemployeesorrepresentatives from contacting a Proposer for the purpose of obtainingfurtherinformation. D. Policy Violations. The Authority may reject a Proposal or response intheevent ofanyviolation of this policy. Any questions from the prospective Bidders will be accepted in writing until noon, Friday, March22, 2024.After this date no questions will be answered. Questions submitted should be directedtoBrianSinnwellat Engineering@flylouisville.com. All questions must be put on the Bid Question Form(SeeAttachment#7). The Authority will encourage the successful Bidder to enter into, and will assist the successful Bidder in securing, a project agreement, or other agreement, to reduce the risk of work stoppages or other labor related delays during the term of the Project. The Authority will encourage the successful Bidder to employ local labor for all but supervisory personnel for the Project.
