Site work and paving for a road / highway in Springfield, Oregon. Completed plans call for site work for a road / highway; and for paving for a road / highway.

Springfield Utility Board (SUB) seeks a contractor to excavate and remove existing asphalt, cold mix, CDF, rock and restore with new asphalt to the attached Contract Documents. The total approximate quantities are provided in the Price Proposal section. The successful bidding contractor is responsible for asphalt/cold mix/CDF/rock removal, compaction, asphalt base lifts and testing, asphalt top lift and testing, pavement milling removal, pavement markings, polymerized crack sealing the joints, saw cutting and all traffic control. Contractor will agree to pay $1,000 per calendar day, not as a penalty, but as liquidated damages in case of failure to meet contracted completion dates. Payment by the Contractor of liquidated damages does not release the Contractor from its obligation to fully and timely perform the contract according to its terms and conditions. Bid Bond: If the Utility estimates the Public Improvement contract resulting from this bid will exceed $100,000.00, each bid must be accompanied by a Bid Bond, cash, or a certified cashier's check upon a bank in good standing, payable to SUB, shall be not more than ten (10%) percent or less than five (5%) percent of the total amount of the bid (OAR 137-049-0290). Such funds shall be forfeited and become the property of SUB if the Bidder fails or refuses to enter into a contract and furnish satisfactory bond within ten (10) days (weekends and holidays excepted) after notification that its bid has been accepted. The check accompanying the accepted bid will be retained until the contract is signed and the contract bond of the successful bidder is approved by SUB. Bid bonds shall be issued by a surety company registered to issue bonds in the State of Oregon and utilizing bond form acceptable to SUB. Payment & Performance Bond: If the contract that results from this bid exceeds $100,000.00 the successful bidder shall furnish, as part of execution of the contract, a corporate Surety Payment and Performance Bond in an amount equal to the full amount of the contract (OAR 137-049-0460). This bond shall be conditioned upon the faithful performance of the contract and upon payment of all persons supplying labor and materials for the construction of the work. The form and surety for the bond shall meet the approval of SUB and its attorney. For this project, it is imperative that pavement restoration and all related work is completed by August 31, 2024 as required by the City of Springfield Permit. SUB will issue a Purchase Order no later than July 29, 2024 in order for the Contractor to complete this work within the 30 day work period. Springfield Utility Board reserves the right to reject any or all bids, to waive minor irregularities not affecting substantial rights, and to accept such bids that in the opinion of the Board are in the best interest of Springfield Utility Board. The successful contractor will be notified not sooner than April 4, 2024 at 4:00 p.m. If applicable, Springfield Utility Board members will vote on the award of contract at the regularly scheduled Board meeting on Wednesday, April, 10, 2024. Contractor recognizes that SUB will sustain damages and suffer financial loss if work is not completed by the contracted completion dates. Accordingly, and without requiring any such proof, Contractor will agree to pay $1,000.00 per calendar day, not as a penalty, but as liquidated damages if agreed upon completion dates and conditions are not met. The parties agree that this amount represents a reasonable estimate of the damages SUB will suffer as a result of Contractor failing to meet contracted completion dates. Payment by the Contractor of liquidated damages does not release the Contractor from its obligation to fully and timely perform the contract according to its terms and conditions. SUB shall have the right to recover any damages in excess of the liquidated damages, as well as any reasonable attorneys' fees and costs incurred as a result of enforcing its rights under this Agreement. This work is Prevailing Wage as determined by BOLI, January 2024 book. Event Bid notes: If not included in the bidder's bid packet, First-Tier Subcontractor Disclosure forms will be received at the above-mentioned location by April 4, 2024 until 4:00 PM.
