Water Main Replacement 2024 Group B Bond Notes: Each bid must be accompanied by cashier's or certified check of the bidder, or a bid bond duly executed by the bidder as principal and having a surety thereon, a surety company approved by the Owner (refer to Section #6. LIQUIDATED DAMAGES : The Contractor agrees that time is of the essence of this Contract, and that for each day of delay beyond the number of calendar days herein agreed upon for the completion of the work herein specified and contracted for (after due allowance for such extension of time as is provided for extension of time hereinabove), the Owner may withhold permanently from the Contract's total compensation as stipulated liquidated damages for such delay, the sum indicated by the following table: The sum of money thus deducted for such delay, failure of non-completion is not to be considered as a penalty, but shall be deemed, taken and treated as reasonable liquidated damages, since it would be impracticable and extremely difficult to fix the actual damages. No plea of ignorance of conditions that exist or may hereafter exist, or of conditions or difficulties that may be encountered in the execution of the work under this Contract, as a result of failure to make the necessary examinations and investigations, shall be accepted as an excuse for any failure or omission on the part of the Contractor to fulfill, in every detail, all requirements of the Contract Documents, or will be accepted as a basis for any claims whatsoever for extra compensation or for an extension of time. Owner Rights: The Owner reserves the right to reject any bid if the evidence submitted, either by the bidder or from an investigation of the bidder, fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the Contract and therefore to complete the work contemplated herein.
