All bids must be accompanied by a bid guarantee which shall be in the form of either: a) a bond secured by a surety compan acceptable to the U. S. Government and authorized to do business in the State of Ohio. The amount of the bond shall be for the full (100%) amount of the bid, plus alternates; b) a certified check, cashier's check, bank draft or irrevocable letter of credit. The amount of the certified check, bank draft, irrevocable letter of credit shall be in the amount of ten percent (10%) of the amount of the bid, plus alternates. The Bid Guarantee shall insure the execution of the contract and the furnishing of a method of assurance of completion by the successful bidder. The assurance of completion shall be: (1 ) a performance and payment bond in the penal sum of 100 percent(100%) of the full amount of the contract; (2) a twenty percent (20%) cash deposit; or (3) a twenty five percent(25%) irrevocable letter of credit. This advertisement is for services related to a project that is subject to the Build America Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act ("IIJA"), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in the project must be produced in the United States, as further outlined by the Office of Management and Budget's Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18, 2022. Notice of requirement for affirmative action to ensure equal employment (governor's order of january 27, 1972) Bidders' attention is called to the provision for "equal employment opportunity clause" and the "standard federal equal employment construction contract specifications". the goals, timetables, compliance and regulations set for in the executive order deemed part of this solicitation by reference. Each bidder must insure that all employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. Payment for labor as it applies to this work shall not be less than the amount established by the U.S. Department of Labor. Bidder's attention is further called to the provisions of Section 3 of the Housing and Urban Development Act of 1968, as amended (12 U.S.C. 1701 u) (Section 3), and are required to comply with all requirements as relates to Section 3, including training and employment opportunities for Section 3 Residents and Business Concerns for this Section 3 covered project. The Akron Metropolitan Housing Authority reserves the right to reject any or all bids, to re-advertise our bids, and to waive any informality in bids received whenever such rejections, re-advertisement or waiver is in the best interest of the Housing Authority. No bid shall be withdrawn for a period of (60) days subsequent to the opening of bids without the consent of the Akron Metropolitan Housing Authority.
