The contractor shall also agree to indemnify and hold harmless the County for all claims, cost and judgments arising out of the allegations of negligence, errors, omissions, or allegations otherwise sounding in tort while performing within the scope of this agreement, to include but not limited to the actions of any subcontractors or suppliers. Bond Notes: Bidder shall submit with the bid a certified check, cashier's check, or bid bond in the amount of ten percent (10%) of the total price bid, but not to exceed $20,000, payable unconditionally to the County of Passaic Pursuant to N.J.S.A. 40A: ll-21. Performance Bond Once the bid is awarded, the successful bidder shall provide the required bonds prior to execution of the contract in the amount of one hundred (100%) of the acceptable bid as security for the faithful performance of this contract. However, notwithstanding the above, the successful bidder awarded a contract for this bid shall not be required to submit a bond in an amount greater than $250,000.00, for the term of the contract, if the bidder's total contract award exceeds this figure on multi-year contracts, the term of the contract shall constitute the entire term. Liquidated Damages : In accordance with N.J.S.A 40A:11-19, liquidated damages are hereby made a part of every contract entered into by the County of Passaic and the winning bidder. If the winning bidder fails to deliver any of the services as outlined herein, the County is entitled to one hundred and fifty dollars ($150.00) per day as liquidated damages, and not as a penalty. Owner Rights: Bids must be submitted in ink or typewritten only. The County of Passaic reserves the right to reject any penciled bids.
