Forest Avenue Substation Site Construction Wage rates paid under this contract are subject to the minimum wage rates established under the provisions of Chapter 149, Sections 26 to 27G inclusive of the Massachusetts General Laws. Each Proposal shall be accompanied by bid security in the form of a certified check, or a treasurer's or cashier's check, issued by a responsible bank or trust company, payable to the Hudson Light and Power Department, for a sum not less than five percent (5%) of the amount of the Proposal, or accompanied by a Bid Bond in like amount of a corporate surety licensed to do business in the Commonwealth of Massachusetts. Each Proposal shall be conditioned that the Proposer will pay Hudson Light and Power Department, as liquidated damages, the amount specified unless it enters into a Contract in accordance with its Proposal and furnishes Performance and Payment Bonds with surety, satisfactory to Hudson Light and Power Department, in an amount equal to 100 percent of the Contract Amount and Insurance Certificates or copies of Insurance Policies. If the successful Proposer fails to enter into the Contract and furnish the Performance and Payment Bond and the Insurance Certificate or copies of the Insurance Policies, its check or Bid Bond and the amount thereof, shall be forfeited to Hudson Light and Power Department. No Proposer may withdraw his Proposal for a period of sixty (60) days (Saturdays, Sundays and legal holidays excluded) after the actual date of the opening of the Proposals. Every Proposal shall be submitted on the Proposal Form furnished with the IFP Documents with an electronic copy and shall be sealed in an opaque envelope which is clearly marked in the lower left-hand corner FOREST AVENUE SUBSTATION - SITE CONSTRUCTION, IFP No. 912409-04. Hudson Light and Power Department reserves the right to reject any or all Proposals if deemed in the best interest of Hudson Light and Power Department and the Town of Hudson, Massachusetts.
