The purpose of this solicitation is to establish a Contract for the provision of Window Replacement and Installation Services at Round Elementary School and will be used as the source for the items listed herein during the term of any Contract awarded from this solicitation. PERIOD OF CONTRACT AND RENEWALS: Time is of the essence. The initial period of any Contract awarded shall commence on the date the Chief Procurement Officer or Superintendent fully executes the Contract and shall terminate on August 9, 2024. MCPS, at its sole discretion, may, but is not required to, extend any existing Contract term for a period of not more than six (6) months to allow for completion of Work in progress at the time of scheduled expiration of the Initial Contract Period or Renewal Contract Period. If the Initial Contract Period or Renewal Contract Period is not extended, all Work shall terminate at the expiration of the Contract Period in which it began. QUESTIONS/INFORMATION REQUESTS All questions related to this solicitation, other than those presented at the Conference, must be submitted in writing via email, address to: Joshua A. REJECTION OF BIDS; WAIVER OF INFORMALITIES: MCPS reserves the right to cancel this solicitation, to reject any and all Bids, and to waive any informalities in Bids. Further, MCPS reserves the right to enter into any Contract deemed to be in the best interest of MCPS. The entire contents of the Invitation to Bid, Instructions to Bidders, any Addenda issued prior to the Bid Closing, and the Bid Form shall be incorporated by reference into any resulting Contract. BID SECURITY No bid security is required for this solicitation. However, by submitting a Bid the Bidder agrees that if the Contract is awarded to the Bidder and the Bidder fails to execute the Contract and proceed with performance of the Contract, Bidder will pay MCPS the difference between the cost of performance during the initial term of the Contract by the next low responsive, responsible Bidder and what would have been paid to the Bidder for the same Work. PERFORMANCE AND PAYMENT BONDS No performance bond and/or payment bond is required for any Contract Award based upon this solicitation. METHOD OF AWARD Except with a Requirements Contract, a Contract for non-professional services or as expressly provided herein, MCPS intends to award a single contract.
