In addition per NRS 338.147 and NRS 338.1389, any contractor wishing to receive preferential bidder status must submit a Nevada State Contractors Board Certificate of Eligibility for Preferential Bidder Status. Each Bid shall be accompanied by a bid security in the form of, at Bidders option, a Cashiers Check, Certified Check, Money Order, or Bid Bond in favor of the OWNER in the amount of five percent (5%) of the bid amount, pledging that the Bidder will within 10 days after Notice of Award enter into a contract with the Owner on the terms stated in this Bid and will furnish bonds, as described, covering the faithful performance of the Contractor and the payment of all obligations arising there under. Should the Bidder refuse to enter into such Contract or fail to furnish such bonds, the amount of the bid security may be forfeited to the Owner as liquidated damages, not as penalty.
