The contract shall: o Maintain workers' compensation insurance as required by Wisconsin Statutes. o Maintain commercial liability, bodily injury, and property damage insurance against any claim(s) which might occur in carrying out this agreement/contract. Minimum coverage shall be one million dollars ($1,000,000) liability for bodily injury, death, or property damage. o Maintain motor vehicle insurance for all owned, non-owned, and hired vehicles that are used in carrying out this contract. Minimum coverage shall be one million dollars ($1,000,000) per occurrence combined single limit for automobile liability and property damage. Contractor to Furnish Pg 58-28 5% Cutback Liquid Asphalt Furnished by and Blended at a State of Wisconsin and American Association of State and Highway Transportation Officials (Aashto) Certified Liquid Asphalt Production Facility, Proportioned With a Certified Scale, and Power Mixer Blended to Specifications, Heated to 350o F and Applied. 6. Chip Seal Aggregate: Contractor to Haul, Place, and Roll 3/8-inch Fractured Pea Stone Cover Aggregate From Town Stockpile in Barneveld. Except as Noted, Pea Stone Application Rate Shall Be 150 Tons Per Mile Single-seal and 240 Tons Per Mile Double-seal, 20' Equivalent Mile. Contractor Shall Not Waste Aggregate: if Application Rates Are More Than 15% Above 150 Tons Per Mile Single-seal or 240 Tons Per Mile Double-seal, Contractor Shall Provide the Additional Aggregate at Their Own Expense. 7. Equipment and Employees: Contractor to Furnish All Machinery, Labor, and Other Necessary Incidentals to Properly Clean, Sealcoat, and Roll Various Town Roads. 8. Traffic Control: Contractor Shall Be Responsible for All Temporary Traffic Control. All Work Will Be Done Under Traffic Unless Otherwise Directed by the Town. The Town of Brigham Town Board reserves the right to accept or reject any or all bids or remove portions of this project for budgeting or other purposes that are in the financial or other best interest of the Town. The Town reserves the right to require higher or lower limits where warranted. In the event that the contractor fails to maintain and keep in force the insurance herein required, the Town shall have the right to cancel and terminate the contract without notice.
