The Toho Water Authority is soliciting sealed competitive bids from qualified and licensed Bidders/Contractors for the supply and delivery of two (2) submersible pumps for Lift Station #06 in accordance with the Scope of Services and Technical Requirements. The Toho Water Authority ("TOHO") is soliciting sealed competitive bids for the supply and delivery of new Flygt (Xylem), Sulzer (Hydra), or Homa submersible pumps for Lift Station #06, in accordance with the Scope of Services and Technical Requirements. Award to be made on the basis of submittal, delivery time, and price. A pre-bid conference is not required for this solicitation. Any interpretation provided to any vendor in response to inquiries regarding this solicitation which may affect the outcome of this bid will be furnished in writing via addendum Toho reserves the right to accept or reject any and/or all bids, or any part thereof and/or to waive irregularities and technicalities. Also, Toho reserves the right to accept all or any part of the bid and to increase or decrease quantities to meet additional or reduced requirements of Toho. Any sole response received by the first submission date may or may not be rejected by Toho depending on available competition and timely needs of Toho. For each item or for all items combined, the bid of the lowest responsive, responsible bidder will be accepted, unless all bids are rejected. To be responsive, a bidder will submit a bid that conforms in all material respects to the requirements set forth in the bid. To be a responsible, a bidder will have the capability in all respects to perform fully the contract requirements, and the tenacity, perseverance, experience, integrity, reliability, capacity, facilities, equipment, and credit which will assure good faith performance. Also, Toho reserves the right to make such investigation as it deems necessary to make this determination. Such information may include but will not be limited to: current financial statements; verification of availability of equipment and personnel, and past performance records. Award will be made to the lowest responsive and responsible bidders within ninety (90) days after the bid opening. Unless canceled or rejected, a responsive bid from the lowest responsible bidder will be accepted as submitted. Toho reserves the right to make an award in whole or in part at its discretion. There is no agreement associated with this solicitation. A purchase order will be issued to the winning bidder. This is a one-time purchase. If Special Conditions require a bid security, it shall be submitted in the amount stated. A bid security can be in the form of a bid bond, postal money order, cashier's check, or irrevocable letter of credit. Bid security will be returned to the unsuccessful Bidders or Offerors as soon as practicable after opening of Bid or Proposals. Bid security will be returned to the successful Bidder or Offeror after acceptance of the performance bond or irrevocable letter of credit, if required; acceptance of insurance coverage, if required; and full execution of contract documents, if required; or conditions as stated in the Special Conditions. If a performance bond or irrevocable letter of credit is required in the Special Conditions, the Contractor shall within fifteen (15) working days after notification of award, furnish to the Toho a performance bond or an unconditional irrevocable letter of credit payable to the Toho Water Authority, Florida in the face amount specified in the Special Conditions as surety for faithful performance under the terms and conditions of the contract. If the bond is on an annual coverage basis, renewal for each succeeding year shall be submitted to Toho thirty (30) days prior to the termination date of the existing performance bond. The performance bond must be executed by a surety company of recognized standing, authorized to do business in the State of Florida and having a resident agent. If a letter of credit is chosen, it must be in a form acceptable to Toho, drawn on a local bank acceptable to the Toho and issued in favor of the Toho. If the Bidder or Offeror wishes to use a non-local bank, he must have prior Toho approval of the requirements to draw against the letter of credit.
