All successful bidders will be required to furnish a Performance Bond and a Labor and Material Bond pursuant to Sections 136 and 137 of the State Finance Law, each for 100% of the amount of the Contract estimated to be between $5,000,000 and $6,000,000 for C The substantial completion date for this project is 351 days after the Agreement is approved by the Comptroller. Owner Rights: The Office of General Services reserves the right to reject any or all bids. If alternates are included in the bidding documents, the State reserves the right to accept or reject any or all alternates. The State shall determine the lowest bid by adding to or deducting, from the Base Bid Amount of the bidders, the additive or deductive alternates, if any, that the State elects to accept after the opening of the bids. Alternates will be accepted in the order they are set forth in the contract documents. The amount of Liquidated Damages shall be the product of $1,000.00 times the number of days of delay in physical completion of the work.
