**As of June 14, 2024, project was awarded to Harbour Construction LLC awarded amount is $230,881.40.** The City of Emporia is requesting proposals for the City's 2024 street preservation program. The program will consist of laying approximately 54,193 square yards of aggregate with emulsion, 54,193 square yards of fog seal, 15,000 pounds of crack seal, 20 tons of leveling course. A statutory and performance bond will be required for this project. A bid bond will not be required. Withdrawal of Bids: A written request for the withdrawal of a bid or any part thereof may be granted if the request is received by the City prior to the specified time of opening. Bids Binding 60 Days: Unless otherwise specified all formal bids submitted shall be binding for sixty (60) calendar days following bid opening date, unless the bidder(s), upon request of the City, agrees to an extension. Rejection of Bids: The City reserves the right to accept or reject any or all quotations, or parts thereof. Liquidated Damages: The City reserves the right to assess a late penalty of up to 2 percent per day, unless otherwise specified, if the commodity or service is not delivered within the time period agreed upon. Bid Bond, Certified or Cashier's Check (For Bid Amount Over $100,000): A certified cashier's check, bid bond, or money order made payable to the City, in the amount of 5% of the bid, may be required of all bidders. The bid bond or check of the successful bidder shall be retained by the City until completion of the work or submittal of a performance bond (if applicable) to ensure the delivery of the supplies and/or service at the specified time and/or the successful completion of the project. Performance Bond A performance bond satisfactory to the City, executed by a surety company authorized to do business in Kansas or otherwise secured in a manner satisfactory to the City for the performance of the work provided for in the contract, in an amount equal to 100% of the price specified in the contract; and Payment Bond A payment bond to the State of Kansas satisfactory to the City, executed by a surety company authorized to do business in Kansas or otherwise secured in a manner satisfactory to the City, for the protection of all persons supplying labor, materials, equipment or supplies to the contractor or its subcontractors for the performance of the work provided for in the contract. The bond shall be in an amount equal to 100% of the price specified in the contract and shall otherwise comply with the requirements of K.S.A. 60-1111. Award or Rejection of Bids: The contract will be awarded to the lowest responsible and responsive bidder complying with the provisions of the Invitation, provided the bid price is reasonable and it is to the best interest of the City to accept it. The City reserves the right to reject any or all bids or parts thereof and to waive any informality in bids received whenever such rejection or waiver is in the best interest of the City. The City also reserves the right to reject the bid of a bidder who has previously failed to perform properly or complete on time contracts of a similar nature, or a bid of a bidder who investigations show is not in a position to fully perform the contract.
