The scope of Work shall include construction access, clearing, foundation installation, tower assembly, tower erection, conductor stringing, and overhead ground wire stringing for up to approximately 42km of the new 230kV R44H transmission line. The Performance Bond shall be in an amount equal to 50% of the total Contract Price including GST. The Labour & Material Payment Bond shall be in an amount equal to 50% of the total Contract Price including GST Liquidated Damages means the genuine pre-estimates of damage to the Purchaser in event of specified defaults by the Contractor in amounts set in SubClause 4.8 [Work Safety] and Sub-Clause 4.18 [Protection of the Environment]. The Contractor shall pay to the Purchaser, Liquidated Damages in the amount of $15,000.00 (CAD) for each Stop Work Order issued to the Contractor during the term of the Contract and Defect Notification Period. The Contractor shall then immediately repay, to the Purchaser, the amount of Liquidated Damages for each Stop Work Order, failing which such amount shall be deducted from the following Payment Certificate. Manitoba Hydro may reject any Proposal where any documents contained in the Proposal cannot be opened or legibly viewed by Manitoba Hydro. Manitoba Hydro has the right at any time to reject any Proposal submitted by a Proponent or terminate negotiations with a Proponent if, in Manitoba Hydro's determination, the Proponent has engaged in any Corrupt, Fraudulent, Collusive, or Coercive Practice or has breached, or is reasonably believed to have breached, any laws regarding corruption or fraud.
