General Contract for the construction of an asphalt trail and concrete curb and gutter along the west side ofAirlane Drive. Earthwork will be performed along with drainage improvements to fill the existing ditch and replace with storm drainage culverts. Reinforced concrete curb inlets will be constructed along the trail to drain the roadway, and a cross-walk will be constructed at the south end of the project. Pursuant to Ark. Code Ann. 22-9-203, the Owner encourages all small, minority, and women business enterprises to submit bids for capital improvements. Encouragement is also made to all general contractors that in the event they subcontract portions of their work, consideration is given to the identified groups. Bond Notes: Each Bid must be submitted on the prescribed form and accompanied by a certified check or bid bond executed on the prescribed form, payable to the City of Benton, Arkansas in an amount not less than 5 percent of the amount bid. The bid proposal and work of the proposed contract shall be in accordance with all applicable federal, state, county, and local laws, ordinances and regulations. The attention of the Bidder is directed to the applicable federal and state requirements and conditions of employment to be observed and minimum wage rates to be paid under this contract. Owner Rights: Any Bid may be rejected which contains material omissions, or irregularities, or in which any of the unit prices are obviously unbalanced in the opinion of the Owner. Also, a bid may be rejected if it, in any manner, shall fail to conform to the conditions of the Bidding Requirements and Contract Documents. The Owner reserves the right to waive irregularities, reject bids, choose the most qualified bidder for the Project. Contract for a period of time which shall not exceed beyond 90 days from the bid opening date. Bids shall be on a unit price basis.
