Performance Period: 365 Continuous Calendar Days Liquidated Damages: Five hundred ($500) Dollars per Continuous Calendar Day and as set forth in the Construction Contract Page 3 Documents Available: May 3, 2024 The SCA reserves the right to reject any bid if the information required by the SCA is not submitted as required or if the information submitted fails to satisfy the SCA that the Bidder is responsible, or is able or qualified to carry out the obligations of the Contract, or to complete the Work as contemplated. Contractors are required to comply with all Prevailing Wage requirements. Additionally, the Contractor agrees to pay for the cost of any investigation conducted by or on behalf of the SCA which discovers a failure to pay prevailing wages by the Contractor or its subcontractor(s). The Contractor also agrees that should it fail or refuse to pay for any such investigation, the SCA is hereby authorized to deduct from the Contractor's account an amount equal to the cost of such investigation. Pursuant to 220 of the New York State Labor Law, all workers employed by contractors and/or subcontractors must be paid prevailing wages and supplemental benefits as provided in the prevailing wage schedules that are a part of your contract. The purpose of this guide is to make all contractors and subcontractors aware of their obligations under this law and to ensure that all covered workers receive the wages and benefits to which they are entitled. The Office of the Comptroller of the City of New York determines the prevailing wage - which includes wage rates and supplemental benefits - for each trade, commensurate with the nature of the work performed. Failure to pay the prevailing wage in effect at the time the work is being performed, as set forth in the Comptroller's Schedule of Wage Rates, is a violation of law which may result in a debarment from public work in the State of New York. The Contractor shall pay to the SCA as liquidated damages the sum of Five hundred ($500) Dollars for each and every continuous calendar day that the Work shall not be completed after the above-stated Completion date or any authorized extension thereof. Each bid must be accompanied by a bid bond prepared on the form attached to the Construction Contract as Appendix C or a certified check of the Bidder, in the amount of five (5%) percent of the Bid Amount, duly executed by the Bidder as principal, and having as surety thereon a company authorized to do business in New York State and approved by the SCA. Immediately upon receipt of Notice of Intent to Award Letter/Signature Page to the Construction Contract, the successful Bidder shall furnish to the SCA and maintain during the term of the contract, at its own cost and expense a Construction Performance Bond in an amount at least equal to one hundred (100%) percent of the contract price as security for faithful performance of the Contract; and a Labor and Material Payment Bond in an amount at least equal to one hundred (100%) percent of the Contract price for the payment of all persons performing labor on the project under the contract or furnishing materials in connection with the Contract. The surety on such bonds shall be a company authorized to do business in the State of New York and approved by the SCA. Plans Available : Required by and in strict accordance with the applicable provisions of the referenced solicitation documents which include, but are not limited to, the plans, specifications and all of the addenda thereto issued by the Construction Manager and sent to the undersigned by electronic transmission or other appropriate means to the Contractor prior to the date of opening of bids, whether received by the undersigned or not; for the total sum indicated on Appendix A attached hereto in the "Bid Amount" block. The project is located at: 1257 Ogden Avenue, Bronx, NY 10452 (the "Site") The Contractor shall commence Work under this Contract at a date to be specified in a Notice to Proceed (NTP) letter issued by the Construction Manager and, shall complete Work on the Project, on or before 365 continuous calendar days from the date in the Notice to Proceed (NTP). The Contractor agrees to be bound by and comply with any and all applicable Prevailing Wage requirement. The Contractor agrees to pay for the cost of any investigation conducted by or on behalf of the SCA which discovers a failure to pay prevailing wages by the Contractor or its subcontractor(s).
