Should the Bidder refuse to enter into such Contract or fail to furnish such bonds, the amount of the bid security may be forfeited to the Owner as liquidated damages, not as penalty. All checks and money orders must indicate the Payee as City of Mesquite and must reflect the complete bid number. A PERFORMANCE BOND and PAYMENT BOND, each in the amount of 100 percent of the CONTRACT PRICE with a corporate surety approved by the OWNER, will be required for the faithful performance of the contract. The PERFORMANCE BOND and PAYMENT BOND shall meet or exceed a standard bond A or A- rating per A.M. BEST. Certificate for the insurance required by section 21, of the General Conditions, will also be furnished by the Contractor when signing the Agreement.
