Principal items of construction include approximately 1,322 LF of 12 water line (including 249 LF of 12 water line installed by bore in 18 steel casing and 90 LF of 12 water line installed by directional drilling), 18 LF of 6" water line, 3 fire hydrants, valves, fittings, service taps, and all other appurtenances, and labor necessary to complete construction and restore the site to existing conditions. The OWNER reserves the right to reject any bid if the evidence submitted by, or investigation of, such Offeror fails to satisfy the OWNER that such Offeror is properly qualified to carry out the obligations of the Contract and to complete the work therein. The applicable wage scale determination is contained with these Instructions to Bidders or the specifications for the Project. CONTRACTOR shall provide and pay for labor in accordance with the prevailing wage in the locality and shall not pay less than the prevailing wage. The protection of existing trees within the right-of-way and on private property is the essence of the contract. For each tree that any work shall damage or destroy, the amount per tree shall be $500.00. This will be deducted from the monies due the CONTRACTOR, not as a penalty but as liquidated damages. In addition, the CONTRACTOR shall replace the tree with a caliper-inch to caliper-inch replacement. The CONTRACTOR acknowledges and recognizes that the OWNER is entitled to full and beneficial occupancy and use of the completed work following expiration of the Contract Time. The CONTRACTOR further acknowledges and agrees that, if the CONTRACTOR fails to substantially, or cause the Substantial Completion of any portion of the Work within the Contract time, the OWNER will sustain actual damages as a result of such failure. The exact amount of such damages will be difficult to ascertain. Therefore, the OWNER and CONTRACTOR agree that, if the CONTRACTOR shall neglect, fail, or refuse to achieve substantial completion of the Work by the Substantial Completion date, subject to proper extension granted by the OWNER, then the CONTRACTOR agrees to pay the OWNER the sum Bid Bond - Each Bid must be accompanied by a certified or cashier's check, or an approved Bidder's bond in an amount not less than 5% of the maximum total bid, payable to the City of Yoakum, Texas without recourse, as a guarantee that the Bidder will enter into a contract and execute performance and payment bonds on the forms provided, within ten (10) days after the award of contract. The projected completion time is estimated to be one hundred eighty (180) consecutive calendar days.
