Bid is Cancelled A detailed, written description of the conceptual requirements for the project contained within a Request for Proposal or Invitation for Bid. The scope of work should establish a clear understanding of what is required by the entity. It shall be the responsibility of the contractor to secure all Local, State, and/or Federal Licenses and Permits required by law, sate or ordinance to perform work. All Bidders shall be registered with the South Carolina Secretary of State's Office by the response deadline. Any Bidder who is not registered with the South Carolina Secretary of State's Office at the time of submission may be found non-responsive and may be withdrawn from consideration. Last Day to Submit Questions June 4, 2024 12:00 p.m. This project will be awarded by lot. There are two (2) lots. Each lot will be awarded to the lowest responsive and responsible bidder for that particular lot. The work on each lot must be completed within thirty (30) consecutive calendar days. If a bidder is awarded both lots, they will have a total of sixty (60) days to complete both. Bond Notes: Each bid shall be accompanied by a bid bond using the form contained in the Invitation for Bid and executed by a bonding company duly authorized and licensed to do business in the State of South Carolina, or by a certified check payable to the order of The City of Columbia, and drawn upon a national bank or a bank and trust company doing business in the State of South Carolina, in an amount equal to five (5%) percent of the amount of the bid, to guarantee the successful Bidder will, within ten (10) days from the date of the notice of award of contract, enter into a contract with the Owner, and execute to said Owner a Performance and Payment bond, the contract and bond to be in the form set forth in the contract, bond and specifications referred to in the Advertisement for Bids. Payment Bond (required of Awardee only): Simultaneously with his delivery of the executed contract, the contractor shall furnish a surety bond or bonds in an amount at least equal to one hundred (100) percent of the amount of the contract price as security for the faithful performance of this contract and for payment of all persons performing labor on the project under this contract and furnishing materials in connection with this contract as specified in general specifications included herein. The surety bond, or bonds shall be executed by a company duly authorized to do business in the State of South Carolina and shall carry a minimum A.M Best Company rating of A- or greater. Said surety shall be subject to approval by the Owner's attorney. Performance Bond (required of Awardee only): Simultaneously with his delivery of the executed contract, the contractor shall furnish a surety bond or bonds in an amount at least equal to one hundred (100) percent of the amount of the contract price as security for the faithful performance of this contract and for payment of all persons performing labor on the project under this contract and furnishing materials in connection with this contract as specified in general specifications included herein. The surety bond, or bonds shall be executed by a company duly authorized to do business in the State of South Carolina and shall carry a minimum A.M Best Company rating of A- or greater. Said surety shall be subject to approval by the Owner's attorney. Liquidated Damages: This liquidated damages provision is non-exclusive and not intended to limit the City's remedy for breach of contract or delay in contract times .Owner and Contractor recognize that time is of the essence of this Contract and that Owner will suffer financial loss if the Work is not completed within the Contract Time (and specific milestones) specified in Article 3 above, plus any extensions thereof allowed. They also recognize the delays, expense and difficulties involved in proving, in a legal proceeding, the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty) Contractor shall pay Owner ($500.00) per day for each calendar day of delay until the Work is complete. Owner Rights: The Owner reserves the right to accept or reject the qualifications of any bonding company submitted by the Contractor. The City reserves the right to accept or reject proposals in part or in their entirety. The Owner reserves the right to reject any bid if the evidence, submitted by, or investigation of, such Bidder fails to satisfy the Owner that such Bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein.
