All bids shall be accompanied by a bid guarantee (in the form of a bid bond or certified check) of not less than five (5%) percent of the amount of the total base bid. If the bid bond is not submitted with your proposal, you bid SHALL be deemed non-responsive. A 100% Performance Bond and a separate 100% Payment Bond shall be furnished by the successful bidder within five (5) calendar days. Time of Completion: All sites to be reclaimed within 180 days from award date. The Commonwealth shall respond to salient questions in writing by issuing an addendum to the solicitation. The addendum shall be posted to the Kentucky Vendor Self Service site. Changes in Scope The Commonwealth may, at any time by written order, make changes within the general scope of the contract. No changes in scope are to be conducted except at the approval of the Commonwealth. The Commonwealth of Kentucky shall have the right to use all system ideas, or adaptations of those ideas, contained in any proposal received in response to this RFP. Selection or rejections of the proposal will not affect this right. For breach or violation of this provision, the Commonwealth shall have the right to reject the proposal or cancel the contract without liability.
